The witness continued—It would be impossible for me to recollect the words of either party; Gen. Scott stated to Gen. Pillow the reasons why he had placed Gen. Scorr (rising and with great calmness)—I ir, on my honor (placing his hand on his heart) 1 have no desires to treat the Court with disrespect.— The decision of the Court is incomprehensible to me Gen. Towson (knocking on the table)—Silence! or- der! Gen. Scort—I sir, have offered no disrespect to the Court on any occasion. [ have always treated it with the same respect which | would pay three Field Mar- shals, and my rank, sir, is far above that; but if it were composed of fifty Field Marshals, 1 would main- tain my rights; I have, sir. seen remarks and remon- strances made to the Chief Justice of the Supreme Court, without giving offence; I repeat, I have always treated the Court with all the respect due three Field Marshals. Gen. Towson (very warm and agitated)—It is not the first time, sir, the Court has been told its rank ‘not equal to that of Field Marshals; but, humble as it it has been appointed to investigate this case, and it will not be insulted. The Court has ae up with un- called for remarks, because it was unwilling to get into collision with the prosecutor; but the 't has estab- lished certain rules for its guidance, one of which is that there must be no discussions, nooral communi- cations—all must be in writing. The Court feels bound in respect for itself, to adhere to its rules; and, if it cannot do so, it will adjourn, and report the case to the proper authorities, who can decide upon some remedy Gen. Scort—I again repeat, that in the allusion to Field-Marshals | intended to mark my respect of the Court, as also when I referred to the proceedings of the Supreme Court. The privilege of remark, remonstrance and suggestion is never denied in any Court that I have knowledge of. I think that the Court has displayed more feeling than necessary. I have displayed no feel- ing, and I shali give up the further questioning of the witness, because in my conscience I cannot understand the decision of the Court. The witness was then cross-examined by Gen. Pil- low. Q.—Witness will state if Gen. Pillow did not express, on the occasion referred to, his gratification that Gen. Scott had appointed Gen. Quitman a commissioner to fix upon the terms of the armistice at Tacubaysa ? A.—He may have done so—I don’t recollect in terms. Q.—Dit Gen, Pillow express any wish to be appoint- ed, or express any regrets at not being appointed, one of the commissioners ? A.—Hie made some expressions which I do not recollect recisely, which conveyed to me the impression that be expected to be appointed, though | don’t recollect the words. Quitman, were those, I believe, which influenced the general-in-chief in the appointment of Gen. Quitma: Q—Did witness ever hear Gen. Pillow at any time express an approval of the armistice? Has he not, on the contrary, heard him express his exceeding regret that Gen. Scott should have granted an armistice, sur- vendering all the advantages won by the army in the battles of Contreras and Churubusco, at the cost of the blood of 1056 officers and privates of the army without any guranty of the enemy's good faith in the proposed negotiation Gen. Pillow, endeavoring to cross the Pedregal. I returned, because I had a very lame foot, and on account of the difficulty of crossing on a very dark night. 1 do not think it was possible to cross where we attempted that night, There may have been other places that we knew nothing about. Cross-examined by the Prosecuior :—Q.—Did Col. Riley at any time report to or inform the witness that the said Riley had also received orders from Major Gen. Pillow, similar to those communicated by the witn: viz., orders directing Riley, with his brigade, to cross the Pedregal in the afternoon of August 1vtlr last ? Gen, Scorr desired to have certain heads of beau- reaus in Washington summoned to prove that the let- ters of different offieers of his staff, which were published in the Union, the official paper, were published by the direction ot the proper authorities. He named the chief of the engineer department and the chief of the ordnance department. He would, be able, by those gentlemen, to fully prove the fact. In answer to the oral motion of the prosecutor to summon the chiefs of bureaus of the War Department to prove that the letters of different officers of Gen. Scott’s staff wore published by authority, Gen. Pu..ow submitted @ written request that tho honorable the Secretary of War should be summoned on the part of the defence. Gen. Prance sworn for the defence, Vitness will examine the letter here-shown him, from Major “en. Pillow to Major Gen. Scott, bearing date the 23d August last, and say what knowledge he has of the delivery to Gen. Scott ? A.—On the day preceding the date of the letter, (the 22d August.) | was the bearer of a note from Gen. Pillow to General Scott's quarters, and my impression is, that I delivered it to some gentleman connected with his staff. Who he was do not remember. I heard the letter read before 1 went, and believe this is the etter. Q.—The letter bears date the 23d Aug. Will witness say if he is satisfied the letter was written on the 22d, and that by mistake it is dated the 23d Aug., 1847. A.—I have no doubt it is the letter I bore on the 224, and consequently there must bee mistake as to the date Q.—Did witness deliver the letter to Gen. Scott, or to some member of his staff, om the 22d of August, and before witness took his seat as a commissioner that day? A.—I did, according to my best recollection ; I have no doubt of it. Cross-eramined by the prosecutor.—At about what hour in the day did the witness hand in the letter he has identified, to some one about Gencral Scott's head quarters? A.—My impression is that it was about 3 o'clock The note addressed to mo required my presence there at that time, and I think I was there about the hour. Q.—When the said letter was handed to witness. was, or not, Major Gen. Pillow aware that he was not appointed one of the commissioners to negotiate an ar- mistice / and had not Major Gen. Scott already drawn up instructions for the American commissioners ? {Here a frightful noise was heard in the street. As it drew nearer, we imagined it to be a tin horn ora Jackass braying. A general rush was made for the door, when it was discovered to be the music accom- panying a couple of troops of volunteer horse, looking quite martial. ‘The noise in the room for a while com- pletely drowned all other sounds. When silence was somewhat fostored, we heard Gen. Towson bawling out at the piteh of his voice, “Sergeant, sergeant! Or- derly ! hello! Come back here, sir! ‘Stop that noise ! Silence! order! order!” and continued, sotto voce. something which sounded very much like “d—d fools !!” But whether applied to the unoffending rucstis who were playing soldiers in the street, or those within the room. who were making a noise, remains a mys- tery. After awhile the examination was proceeded with, by the witness answering the last queston.} A.—I so understood it. Q.—Does the witness chance toknow what ge the views of Major General Pillow on the 21st and 23d Au- gust last, prior to the appointment of commissioners. respecting an armistice? and if so, were those views opposed to an armistice ? A.—I never heard Gen, Pillow express any opposition to the armistice until he returned from ‘Tacubaya on the 22d of August. [had had’very little conversation with him in relation to it, and am not certain that he expressed any opinion either for or against it, until the time above referred to. Q.—Was or was not the subject of an armistice alluded toin conversation between Maj. Gen. Pillow and witness, prior to the appointment of American commissioners, relative to an armistice ? A.—I think it was. Q.—Does the witness chance to know whether Maj. Gen. Pillow was in favor of a very early attack by the American army upon the Mexican eapital® about the ilth of September last, or whether the said Pillow was not in favor of a colay for some purpose ? and if 60, for what reason ? A.—I have no knowledge upon that subject. Q.—Did the witness chance to be present at any conversation between Major Gen. Pillow and Mr Freanor, an agent for the New Orleans Delta, on the subject of communications to that paper, and doing | something for his benefit? and if #0, please state the substance of that conversation. A.—I remember but one conversation between Gen. Pillow and Mr. Freaner, and that could be hardly called wconversation. | will state the substance. Gen. Pil- low introduced Mr. Freaner as the correspondent of the Delta; said he w: man to be relied on, and ex- pressed his interest for the paper, and his intention to endeavor to increase its circulation and influence. Mr. Freaner remarked, that the character and circula- tion of the Delta were alroady such that it did not stand in need of any individuai’s exertions or patronage, or words to that effect. That is the substance of ali the conversation I ever heard between Ge. Pillow and Mr. Freaner, Q —Was there or not. on that occasion, handed by Major Gen. Pillow to Mr, Freaner. some paper, in the nature of a communication for the Delte, or the basis of one? A.—If there was. I haye noreecllection of it.
