pd the House, you will be allowed counsel If you a “X same investigation, (page 4} 416, House Jour. 2d ses, 24h Congress) Fairfield, member of the committee, testified, that th ere was “a rule of the committee that all questions should be reduced to writing, and propounded through the chairman, to witness, if not ob- jected to by a member of the comunittee ; and that all answers of wit should be returned — the same channel Bell, the present eminent Senator from BE wh a doubtless remembers that being sum- moned asa witness before Mr. Wise’s commit- tee, above mentioned, he was permitted to give his testimony in writing. He will probably re- collect it, from the tact that a poridon of his evi- dence, written on a detached slip of paper, was accidentaily omitted by the person who copied the manuscript for the press. I could cite a number of additional cases; but the foregoing are quite sufficient to show that this right, which was denied to me, has been generally, it not invariably, granted to witnesses under similar circumstances. Thus fivding myself before a secret tribunal alone, without the aid of counsel, examined for e purpose of which I was not acquainted—retus- the smallest gleam of information necessary for my guidance—opposed to men lrarned in the law—called upon to make replies, uny one of which might subject me to punisnmeat, as for contempt—demied those meansot guarding against mistake which had never before been refused in like cases—isolated from al those fostering defences which the constitution and the laws should raise up around every citi- zen, against rathiess violence aad oppre-sion, { demanded that at least | might be permitted to act as my own counsel; and my applicauon was refused. I asked that my, right should be recog- nized to interrogate the Senate as to what they meant to elicit by such questions as I might ex- ceptto; thismght was not recogaized. Why should this privilege be withheld from me. which would have been accorded to my counsel for my benefit, if I had beea defended by coun- sel? So far was this privilrge from being ac- T was not permitted to ut- corded, however, th ter a word which was not recorded as part of my answers? Has the Senate avy palliation for this most aporeseive course? Whatcrime had [ com- mitted? The worst offence charged was refusal to answer questions put by committee: of the Senate, which refusal was sustained by the com- mittee themselves, all the members of which were men of consummate legal ability. Was this a justification for my torcible arrest and de- tention, and for dragging me before the bar of a secret Cart where | looked upon no face but those of my jud; aes and their officials? Wasthis rovocation for battering down with furious vio- ence, the weak muniments of law, which, in haste, I had snatehed up for my defence, and placing me inthe arena, unarmed, defenceless, gagged and fettered, and exposed in this condi- tion to the assaults of men powerful and cua- ning of tence, and whose customary acuteness was sharpened by their animosity ? And I again ask, where, during this small cru- sade, were the Senators from New York? When this most unmaaly and toul game was being pluy- ed, what was the bearing of those on whose support Ihad naturally a claim? Did they denounce this unwarrantabie assault on the constitutional rights ot the citizen? Alas! not so. One sat silent, and the other did not sit at all. He fled Will they attempt to justify the course of the Senate? and it they will not, can they justily ther own tame acquiescence? GatviENsis. —as= BY OVERLAND EXPRESS, INTERESTING.
