The Senate—The Mexican Tariff Question—Mr. Sevier. Mr. Berrien gave his reasons to-day for voting against the treaty. Mr. Webster delivered at speech, which, though short, was the best effort he has made during the session. His argument went principally to prove the illegality and un- constitutionality of the order of the President tolevy taxes in Mexico. This is avery grave question. It is, perhepe, well, whether Mr. Webster and Mr. Calhoun are right or not, that the attempt be made, neverthe- less, to curb as much as possible, the exercise of power, which is et best but implied ; but yet some of the positions taken by these gentlenien seem scarcely tenable One of these is, ttat the President cannot exercise out of the United States authority which he cannot exercise with- in their limits. But he cannot levy contributions in the United ,States; therefore he caunot levy con ceahusiene in Mexico, which is absurd; for the laws of war give a conqueror the right to levy on the people of the coun- try with which he is at war, contributions for the support of his soldiers. But Mr. Webster asks, ‘* Who is the conqueror?” and be answers, ** Not the President, but the people of the United States.” Most true—just as much as Great Britain was tbe conquerér in those battles won by her arms 10 the Peninsular war, although the commanding General, Wellington, was the actual conqueror Well, *who ever doubted his right to levy contributions during that war, without the ‘sanction of an act of Parliament It has never been doubted, Who has ever called ip question General Scott’s right to levy contri- tious in Mexico, on his own responsibility, ashe did, having even instituted, for that purpose, at Vera Cruz, a tariff of duties on imports ? It cannot be doubted. Will it then be contended that, in the General-in-Chief of the army is vested a power over the operations of that army, not possessed by its Commander-in-Chief ? Can General Scott, who is subject to the orders of the President, as his commander, do that which the President cannot do? Certainly not. a But it is said this is nota contribution. It smerely a military order, designed and ope- rating for a specific purpose, and wanting that Catholic character stamped upor all lews intended for general observance, so that the President has made no unconsiitutienal law in Mexico, forhe has made no law—has werely is- sued a military order; he has done nothing but what was lawful for his subordinate, aod was therefore lawful for him to do—and it is absurd to say that the President caunot exercise, eut of the United States, power that he cannot exercise within their limits, for he can levy contributions in Mexico, and he cannot in the United States, Mr. Sevier, in consequence of asevere illness, will not be able to set out on his way to Mexico before sols morning. Doubts prevail as to the success of his mission, and many Senatora voted for the treaty in the fe jositive expectation that it will never be ratified by the Mexican ge- vernment. Mr. Badger, of North Carolina yesterday made a speech on the mission to Rome, some- what similar in spirit, though not quite so in- decent as Mr. Levin’s speech in the Heu It is to be regretted§ that such an unclean spirit should be suffered to enter the Senate. The anniversary supper of the Hibernian So- ciety, held last night at the Exchange Hotel, was one of the most joyful scenes that it has ever been my good fortune to participate in. The entertainment was grand, the viands delicious, the sentiments, speeches and songs, such as can- not fail to retain a hold on the recolieetion of all prerent, as one of the green spots of life. Among the guests was the Hon Henry Clay, accompanied by Chris- topher Hughes, Eeq. They remained from ssven to ten o'clock, and added greatly to the zest of the entertain- ment.
