Justice McCoun, the chair- man of the committee, who is a gentleman of much dig- nity and personal superiority, observed that it had been the object of the committee to make these rules conform as fur as necessary to the original practice of the Court of Chancery; he hoped the time was not far distant when the conflicting forms of proceeding would be laid aside for ® more uniform course of proceeding; the Jearned judge alluded to the legislature as having con- fided the simplification and revision of the rules of prac- tice and forms of proceeding to a board of ooimmission- ers; he was not disposed to doubt the wisdom of such a reference of this business. The learned gentleman was evidently anxious for the success of the elective ju- diciary, and he may have been slightly apprehensive that the incipient steps which would be taken to ensure the smooth and efficient operation of the courts would not be beste f successful. This undertaking is certainly one of ua coommns impor- tance; ® thorough acquaintance With equity juris- pradence, and its application in oases of extreme doubt and difftculty—intellectual celerity, wisdom and energy and industry, and, finally, a pure heart, are all requisite to conduct the preliminary and initiatory operations of ‘this court to basis of successful permanence, to which the legal gentlemen of the State may point asa great triumph over the dogmas of thisoentury. | expect such @ result; but if it happens, I shall refer it to the capabili- ty of aureral jurists who have fortunately been elected to court.
