Inteasstine to Frown Deavers,—A case was tried at the Oswego Circuit a few days since, in which flour dealers may fewl alittle interest. A suit was brought by Bronson & Crocker against T. Wiman, on a contract for the purchase of 2,000 barrels of flour, in October, 1846, which the defendant subsequently refused to de liver according to the terms of the contract, on the ground that the purchase was made upon a misrepresen- tation of facts in relation to English news, which put up the price of flour one dollar per barrel. ‘The defence rested upon showing that the plaintiff alone were in possession of the intelligence, through a private express, when the Nempgen was made, though stating that they had nothing but the public intelii- gence. ‘A number of witnesses were examined and many let- ters read in evidence, on the part of the defence, to prove the misrepresentation and the knowledge which the plaintiffs had of the news at the making of the con- tract. On the other hand the plaintiffs proved that Wi- man acknowledged himself satisfied with the contract after the news had transpired; on which testimony the Jury, under bees fd of the court, rendered a verdict ot $1,622 in favor of the plaintiffs. ‘The Coal Trace.
