McNulty this morning, ih com- pany with histriend and surety, Mr. Leonard. The accused never looked better in his life. Indeed, his arance is more like that of a bridegroom than of a criminal ty a for a revere Stron; declarations are made by his friends, that he will wash his, hands clean of his alleged embezzlements. So we hope, but we shall see. The trial will be held over for several days, in order to the collection of the witnesses. i 2 ‘The Baltimore and Ohio Railroad Company have retused to accept the resignation of Louis McLane, their President, but have appointed, during his ab- sence in England, Samue! Jones, of Baltimore, to fill his place. 1t is a profitable berth, the Presidene of this Railroad Company, $6,000 a year, and travel- ling expenses. The result is, that if Mr, McLane should be recalled by the Senate, he will pocket his $318,000 for the outfit to, and the return trip from, London; and go right in inte his comfortable post of President of the Baltimore and Ohio Rail- yoad Company. Meantime there are amor great unwashed of the party, terrible outeries r against this heretical appointment of a Conservative to the Court of St. James. No man, in their esti- mation, should go, who had ever condescended to admit that Harrison was a brave man, or that his soul escaped the devil. There isa class of unwash- ed Subterraneans, unqualified for otlice, and too lazy to work, who are the greatest annoyance of the administration. We hope the President will continue to act independently of their clamor, and fearless of their contact, persecution, or infiuence. We learn, further, that Mr. Secretary Bancroft has another rod in pickle for Capt. Voorhees, as soon ag the present trial shall have closed. The second trial is to be upon the charge of cruel and malicious floggings of his men. We think he will be acquit- ted upon the first (for his interference in the Monte Videan blockade), as the weight of the testimony appears to be in his favor. ‘The decision may be axpected to-morrow. _ ne Numerous Executive commissions, such as Postnasters, Revenue Officers, Land | Re pistes &c., which expire Ist July next, are being filled up again with “new men,” according to the rule of ro- tation. ‘The election of Polk having depended upon New York, and the vote of New York having been se- cured by Silas Wright, it is understood that Mr. Wright is Mr. Polk’s first choice forthe succession, and that the ‘old democracie” of New York are perfectly aware of the preference of the Executive. ‘Wasurneton, D.C., June 20, 1845. atria of Captain Voorhees continued. le court martial met this morning at the usual hour, all the members being present ; the Judge Ad- vocate proceeded with the reading of the journal of yesterday, and the President siguified 13 approval of the same. On motion of Captain E, Forrest, it was moved that the court proceed to the hearing of the evidence being read. Objections being made, the vote of the court was taken upon the reading of the evidence, which was lost. At this stage of the proceedings, a confused bustle and Jow toned conversation was carried on by several of the court. ‘The Judge Advocate intimated to the president that he wished to reply to the defence of the accused. Manitest. objections were displayed by the whole court, whereupon a discussion arose as to furmer precedents, and the course pursued by Judge Advo- cates in former court martials, the judge maintaining that it was customary fora replyto be made. The court replied, with the permission ct the court, the judge may be allowed to do so ; the Judge Advocate cited the case in McKenzie’s trial, as one in point, saying that to hear only the detence was like a trial alfon one side, and if such a course were pursued in the civil courts, criminals would feel great satis- faction, as the chances for acquittal would be greatly in their favor. The court still remained obdurate; the Judge Advocate then suggested that the counsel for the defends might misconstrue or misapply the evidence, &c. Wc , and the Jndge Advocate would be debarred from showing the testimony in its true light and application, by not being allowed the privi- lege of a rejoinder. The court replied that it would take care of that. The Judge failiag in this, told the Court he would again read, after the defence should be delivered, the opening portion of the jour- nal in relation to the points of law involved, &c. &c. It he does this he will perhaps make a short speech on the occasion. fe i After this desultcry conversation, Captain Forrest moved to reconsider his former motion. On taking the vote the court agreed to reconsider. A motion was then made, that the court proceed to the reading of the journal, which was carried. The court was then cleared for the purpose of reading over the evidence. * * Mr. Cox, the counsel for the accused, will deliver his written defence, to-morrow, Satarday, ut ele- ven o’clock. Un the same day, and before the court finally adjourns, they will determine what sentence, ifany, be passed on the accused. It is meationed incidentally in the last night’s of- ficial organ, the Union, that another trial will be commenced against Capt. Voorhees, so soon as this one adjourns. L had heard of this before thus noticed by the organ, but did not credit the report ; but now it assumes a different character trom that of mere report. The next trial will be, if 1am correctly in- formed, for flogging his men unjustitiably. ‘This, together with the course that has been pursued throughont this trial, now closed, makes manifest to me, that there is a full determination to “leave no. stone unturned” to convict Capt. Voorhees, and if possible to mete out to the accused some kind of punishment. What that punishment may be, I can- not say. 1am nota “prophet, nor the son of a pro- phet,” and therefore will notpretend to prophecy ; but f will simply inake a gness, and let your readers notice if I guess right or wrong What I propose to guess is this—that if the court honorably acquit, or unqualifiedly acquit the accused without any sen- tence, it will not be approved, but a new trial order- ed. Be patient and “bide your time,” and as the Frenchman says, “Ve shall see vhat ve shall see.” it was knowingly remarked in the court room, on Thursday, that the question proposed on the part of the prosecution, came from the Navy Department. How true this is, [ intend not to say, but simply to notify you and your readers, that such was hinted ubout. The trial of Mr. Baker, mate of the brig Montezuma, charged with having been engaged in the sinve trade, is still progressing in the District Court. The sentence of Capt. Political and other so- cieties, including the Temperance associations and the Odd Fellows, are passing resolutions upen the subject of the death of the Old Hero, and have concluded to join in the grand procession, Nothing is heard or talked of but it, except a little in the theatrical line, and there is every indication that the spectacle will be the most im pressive ever witnessed in this city.
