It will be perceived that the importation of free goods is larger thus far this year than for the corresponding period in either of the two previous ones. This fact has undoubt, tedly a slight influence upon the revenue frmo Customs which in connection with the reduced average duty upon the dutiable imports, has reduced the revenue very much this year compared with last. Subscriptions to the capital stock of the New York and Evie Railroad progress very slowly, and at present there appears very little probability of the three millions being subscribed within the time required by the new charter, We learn that there are capitalists standing ready tocome forward and make up the fifteen hun- dved thousand dollars wanted, provided certain changes wre made inthe management of the company. Onr capi- talists, who have not as yet subscribed one dollar to the stock of the company, and many old stockholders, will not invest one dollar in the work so long as it is under he management of the present president. The success ofthe road, therefore, depends upon Mr. Lord’s resign ing at once, There is a strong prejudice in the public mind of this city against him as president of the com. pany, and so long as he occupies that position, so long will the work linger along until the time extended by the Legislature transpires, and the concern falls through. ‘Che extravagant expenditures made upon the road, and tho mismanagement that has characterized all the ope- rations of the company from the first moment of its exis. tence, are attributed tothe want of tact or talent of Mr. Lord, and it is not surprising that capitalists object to in- vest their funds again where they have been so reck- lovely expended. In relation to Mr. Lord personally, we believe him to be a high-minded and honorable man, but the success of the Erie Railroad demands his imme- diate resignation of the presidency of the company. President Siek—Old Tecumseh in Town—Mr. Hoy —the “ Young Democracie”— Nava! Court Martial —Cirewt Court and C. J. McNulty. We regret to infurm you that the President at his rooms at Coleman’s, is a sufferer trom the general complaint of the season. Fortwo dayshe has re- ceived no company. Another day’s rest, however, and proper stimulants and tonies, may brace him up again. Never have we heard of such numerous cases of dysentery as are at present complained of in this city. The uncommon and insuflerably op- pressive heat of the weather is the cause. Col. RK. M. Johnson, (old Tecumseh) right straight through from Kentucky, arrived at the U. S Hotel this morning. Thence he goes to his old friend, the Rev. Obadiah B. Brown, of whfom such ridiculous stories have been told regarding the “pa- per and twme,” during the administration of Gen. Jackson, when father Brown was in the Post office, you know. Old ‘Tecumseh bright as a new dollar. Mr. Hoy, late Postmaster at Philadelphia, is also and is quartered at Coleman’s. The “Young Democracie,” we are afraid, are going to play the mischief with the administration, if they possibly can. Since the ejection of Van Nesa is beyond recali—since the Tylerites seem to be the choicest game—since Dr. Collins himself, the first auditor, and the especial friend of Mr. ‘Tyler, will, perhaps have to go, there is deep, lugubrious and ominous grumbling among the ‘Tylerites, alias the Young Democracie, properly so called becanse they are only three years old. 3 ‘he idea that Captain Polk did write letiers of pro- mise of office to Mr. Van Buren and his friends in Columbia county, before the election, is perfectly absurd. Never thought of such a thing. And it is nothing more than an involuntary act of gratitude, which leads Captain Polk to take care of the friends of the “great rejected.” ‘ The Board of Naval Court Martial, in the case of Captain Voorhees, re-assembled, pursuant to ad- journment, at ten o’clock this morning, The offi- cial report, of Captain Voorhees to Commodore Turner, of the transactions between the United States ship under his command, and the Argentine, or Buenos Ayrian squadron, was read before the Court. This report, which was ruled out yesterday, was admitted by the Court on the request of the Judge Advocate, (as understood.) Nava Courr Marriat.—The Court were oc- eupied sometime. this morning xeading the correspondence of Commodore Shubrick to Mr. Hamilton, Consul, relative to the neutrality, and from Mr. H.to Genera! O’Ribe on the same subject; also despatches to the Secretary of the Navy-—one of which enclosed a copy of fie orders: te Oapense Voorh n evidence of the. fet of the block- ade not being injurious to the United Stntes, and of the blockade being recognised by the proper autho- rities. Lieut. Brooke sworn.—Was Lieutenant of the Marines, and as such, commander of the guard of the ship Congress, in 1844. Did not see the oceur- rence between the Rosalva and the Sancala. Was present ata conversation, on the 29th September, between Captain Voorhees, and Commodore Fitton of the Argentine squadron, as a witness of said conversation. Captain Voorhees asked Captain Fitten if he were the commander of | the Buenos Ayrean squadron. Capt. Fitton replied that he was,or had been before he was required to strike his flag that morning. Capt. Voorhees asked of the Argentine commander if his name was Fitton, and whether he should know him as Admiral or Com- modore. Capt. Fitton replied that his name was John Fitton, and that plain John Fitton would do for him. Capt. Voorhees ordered the Clerk to write itCom, Fitton. Capt. Voorhees asked how long it had been since the Buenos Ayrian government had declared hostilities against the United States. Capt. F. replied that he was not aware that such was fact; but was of the opinion that the United States had commenced hostilities against Buenos Ayres. Capt. V. made no reply to that remark ; but took a letter from his pocket, and said that he had a letter of complaint to read against one of the vessels of Capt. F*.’s squadron, which he did read. The letter was from Silas E. Burrowes, owner of the barque Rosalva, who was on board said barque atthe time. He complained that several balls had been fired into his ship by a Buenos Ayrean schooner that morning; and Capt. V. asked Capt. F. if the hostile act com- plained of was done under his order. Capt. F. promptly disclaimed having authorized the act, and that at the time he knew nothing of it. Capt. V. id, ** You disclaim, then, having authonzed the act?’ Capt. f d, Yes.” Capt. V. then re- marked that he hed another complaint against one of the vessels of his (Capt. F.’s) squadron. She had, a short time before, as he had understood, fired into the Bainbridge. Capt. F. immediately apologized forthat. Did not suppose, at the time, the Bainbridge a man-of-war, nor a United States ship; did not see her flag or pennant. Capt. V. concluded by saying, “that as Capt. F. had apologized for firing into the Bainbridge, he released them, (meaning the officers of the Argentine squadron on board the Congress as prisoners) not including the officers and crew of the Sancala, viz—two officers and nineteen whom he should detain till he should hear from the Commander of the American Squadron; and he should retain them as pire Capt. V. then said to . F. and his other officers,“‘you may now return on board your ships and hoist your flags.” Capt. F. replied, and protested in a most solemn manner against the proceedings which had taken place that morning in regard to his vessels—he would have nothing to do with them if he went on board—he would not give an order, and if the ships were dam- aged, or should tun ashore, it would be at the risk of the United States. He should give no order till he heard from his Government, nor hoist a flag; but he would give orders to the commanders of the other vessels of his squadron to do likewise.— Capt.V.replied “that he might do as he pleased about that,” and then got up and walked to and fro in the ha cabin for some time. Capt. F°. said he regretted that Capt. V. had not thought fit to hold a conversation with him before he ordered him to strike his flag.— Capt. V. said that, “you struck us first; and that it was a rule laid down by his country and by himself, that whenever he or she was struck first, to strike back, and seek an explanation afterwards.” Witness then left the cabin. ‘ It was now very near three o'clock, and Le the Board had despatched the Orderly for another witness, we left, satisfied that if he came, the Board would prefer adjourning to dinner, to the hearing of his evidence to-day. s oe Mr. Hoban for the demurrer, put in to the Cireuit Court, against the several indictments of C. J. MeNulty, late clerk of House of Representatives, for embezzlement of the public moneys, continued his argument one hour before the Court this morn- ing, prior to the resumption of the more regular bu- siness. He maintained the insufficiency of the in- dictment, because of the vagueness of the specifica- tions. We give you acopy of one of the indictments, of which there are six. ‘The three counts in this in- dictment relate we believe to the $10,000 or $15,000, deficit in the transaction with Woodworth and others of Mount Vernon, Ohio. ‘The several indicynents cover an aggregate deficit of about $33,000.
