On this bill an examination was had, as stated in the indictment, on the 8th of January, 1842, before a master ; and it is further alleged that Mr. Ashley eom- mitted Porjury on that occasion, by stating in his answer that he did not then own the property 18 Grand street, nor had collected rents, or had any interest w ever in said property, since’ his conveyance to F banks. Fairbanks assuming the payment of the mortgage, has never received any of the rents from the premises, nor has he any control over them. The deed was given without altering the original consideration of $6,000, not deeming it material. The answers of Mr. Ashley to the bill filed by John Haggerty and others, March 1842, were now read. « The defendant answering, says he has no interest in the pre- mises, No. 18 Grand street, and denies that any portion of the money received as a consideration for the property, has ever been repaid; and he further avers that it was a bona fide sale, and not intended to defraud creditors; and although the deed was granted to Henry Fairbanks, the money was advanced by Robert Dudlex, who is now and has been since the making of the deed, the real owner of said property; though his name was not insert- ed, at his own request.
