Ordway, indicted for perjury in falsely swearing to the schedule of goods lost at the fire inthe buildivg in South William street, in which he kept his store ‘Eounael for Ordway having demurred to the indictment on the ground that the affidavit was illegally taken, inas- much as the document was sworn to before a Notary Pablic, who was not authorized to administer the same, and was therefore no perjury at common law ; the Re- corder proceeded to deliver t e decision of the Court in the matter, sustaining the demurrer as well taken. Aldermen Drake and nypseay who were the associates of the Recorder on the bench at the time the demurrer ‘was put in, dissented from the opinion and decision of the Recorder in the matter, gave it as their opinion that by the 44th chapter, 2d vol. of the Revised Statutes, it was clearly laid down that Notary Publics were empowered to administer such oaths. The majority of the Court being adverse to the admie- sion of the demurrer, it was not sustained, and judgment was rendered for the le. The ral cases of Patrick Fitz- Nolle Prosequi—in the patrick, Bridget Fitzpatrick, Margaret Larkin, and John Carroll, indicted for assaults and batteries,nolle yequies were directed to berecorded, and the parties dismiseed, = the witnesses for the prosecution were not in atten- lance. Tra Wood vs Michael Connelly — Common Assault.—This was an act.onot trespass for assauit and battery alleged to have been committed under the following circum- stances:—It appeared that the plaintiff in July last bought butter from the defendant, who is a respectable merchant in this city, which, by egreement, was to be paid for in cash on delivery. Plaintiff, it appeared, subsequently came for the butter, and not complying with the term: per agreement, was proceeding to take away the defe ant’s butter, when an altercation took place, and the de- fendant, who is an able, athletic Captain of the Monteo- mery Guards, gave Wood a sound drubbing. The Court charged very favorably to Mr. Connelly. Verdict $10 damages. For plaintiff, Raymond and Clarke; for defendant, Mr. Mulvey. Before Chief Justice Jones. Jaw 11.—John Berbeneat ve. Ouro River.—At Wheeling, on Wednesday, there were seven feet of water in the channel. zs At Pittsburg, on Tuesday afternoon, the river had six and a half feet of water in the channel- Anorner Sreamer Lost.—The Vicksburg Whig € of the 25th ult, says— A passenger who came up the river on the steamboat Superb, informs us that at 8}, r. M., on the 224 inst, when near Bayou Gonla Landing, ten miles below Piaquemine, she came in collision wit the steamboat Hiwassee, bound down, from Bayou Black, with sugar and molasses ‘The Superb was running close round the middle bar, when some two hund! distant,the Hiwassee took a shear and ran directly across the bow of the Superb. The latter boat backed her en- ine, but was unable to avoid striking her forward of the Boilers, onher starboard bow. ¢ Hiwassee sunk in eight minutes. Her cabin instantly parted from the hull, and drifted close to the Superb, which beat succeeded in saving all the passengers and their baggage. Bennett, Esq :- There is no mistake of the disappearance of Messrs. Clingman, ef N. C., and Yancey, ot Ala- bama. They have certainly gone out to fight.— They have managed the affair with the most watchtul secresy in order to escape the pursuit of the civil authorities of this place. The keenest anxiety prevails as to the result of the meeting and the place. One rumor this merning was, that they had gone to Winchester, Va; a later rumor is, that the parties and ull concernedhad been arrest- ed in Baltimore. We believe neither the one aor the other. Mr. Huger, a son of Senator Huger, is the second, we learn, of Mr. Yancey ; Mr Clingman’s we e not been able to learn ; bnt are informed that it is a North Carolina gentle- man. No member of either House are with the Parties, as we are assured. Mr. Yancey, is a smail-sized man, a) rently of 26 or 27 years of age, and has a fami: Mr Cling- man has not this incumbrance. He appearsto be not over 40 years of age ; but is eo thin and cadav- €rous, that it is possible he may be not over thirty nya we are certified that his age is not more than 32, itis said that when Yancey received the chal- lenge of Clingman, he sent back with hi accept- ance, the objectionable matter of his speech cf Docedey, thus casting his defiance into the very teeth of the North Carolinian. He is said to hold Mr. Clingman in the deepest contempt. Clingman isan amiable man generally, but is aid to be brave as a bull dog. . w. Wasuineton, Jan. 10, 1845. Gen. Bennett :— : We have the satisfaction to inform you that the Supreme Court has reversed the decision and verdict of the Circuit Court of this District in the case of Stockton & Stokes, Mail Contractors, vs. Amos Kendall, Postmaster General. You will remember that Mr. Kendall withheld the payment of a large sum ($100,000, or a portion of it) from Stockton & Stokes, because he believed the bill exorbitant and unjust. The claim was tried and proved to be valid, and damages were fixed upon Mr. Kendall to the amount of $16,000, the sum of the interest which had accrued upon the bill re- fused. Acting, as Mr. Kendall did, for the Go- vernment, he did his duty, and the common sense of justice, with every man, will admit that the damages upon him, as a private individual, incur- red in the faithful discharge of a public trust, were not according to the spirit of the law. We rejoice at Mr. Kendall’s release from the prison bond and the damages. Chief Justice Taney delivere the opinion of the Court. Bennetr:— The drama, which has been lying in Washington in @ hopeless state of torpidity for two years past, is to be revived by two old campaigners on Mon- day next. First, by Mr. Ward, at the Assembly Rooms, somewhat after the plan of Mitchell’s Olympic. Among his company, are Mrs. Timm, late of Mitchell’s Olympic ; Miss McBride, Mrs. Hautonville, Miss Pauline, and Miss Nichola, of Philadelphia; and John Sefton, of New York ; Messrs. Brunton, Thompson, and Anderton, of Philadelphia; Mr. McDonald of New York, ard Mr. Ward. He opens with the plays of Theresa’s Vow, and the Blue Domino. Secondly, Mr. W. E. Burton, of Philadelphi: opens the National with the ** Lady of Lyons,” an ies among his corps histrionic, Mr. Geo. B-rrett, Mr. E. Conner, Mr. and Mrs. Burke, Mise Kirby, and others. Mr. Dailey, and the teading of the journal, the question of the ANNEXATION GF TEXAS _ was broached by Mr. Harr, of N. H, in a new proposition, or provise to any scheme which might be adopted, which he moved to refer to the Com- mittee of the Whole on the state of the Union and to be printed. The proviso, in substance, is as follows: — Provided, That immediately after the settlement of the question of boundary definitely between the United st toi and Mexico, and before eny tute ‘rom the territory of Texas shall bs admitted into the Union, the territory of Texas, aw nearly as may be, shall be divided into two qual parts, from a boundary beginning sta point midway ‘athe East rn coast, on the Gulf of Mexico, end runnin; North. Westward to the extreme Western boundary ; that in all the division of the territory South and South- West of said boundary, there shall be neither slavery nor involuutary serv.tade, except in cases of punishment of crimes ; and thet this Compact shall remain forever un- alterable, unless thr ee-foui ths of the Statea ef the Union shall formally require its amendment or modification.
