Joha T. Newton, in which the Nava! Court Martial now assembled in this city have been engeged for the Jast three weeks, terminated yesterday. ‘The cose, which has occupied so large 4 portion of the aitention of both offl- cers of the navy and civilians, deserves more than @ ad sing notice. One of our most distinguished and gall officers has be: n arraigned on the charge of negligence in the loss of that splendid steamship, the Missouri which was destroyed by tire at Gibraltar in August, 1643, and which he Commanded. In order to find where the bieme, if ony, really rested, charges were preferred against ber commander. The true object of this trial was to elicit every fact, and to make the whole matier one of record. ‘There has been but one epinion as to the entire end full exculpation of Copt. Newtou irom any cep: on this great national misfortune. His late trie) before @ court composed of men in whom we see the identification our country’s glory, has removed even the most imagi- native point that mignt momentarily have ap, eared to it a rhadow wu cutcheon. Patiently bas he passed through this ordeal, and nebly bes he met and con- futed every charge and specification. Yesterday, at 2 0’ clock P.M., the i: ied for delivery of the defence Capt Newton and his counsel, Philip Hamilton, Esq, ef New York, appeared in court. it were impossible for me to e more than @ faut idea of an address which occu- pied an hour and three quarters in delivery. ‘The testi mony of the w clearly and skiltully ar- ranged, that which before h simplicity of this, arrangement denoted the master mind, its terseness the scholar, its legal acumen one well versed in the theory and practice of hus proies#ion. ‘The discipline of the ship was proved by many witnesses to have been of the best, With regard (o the turpentine itwas clearly shown to have been carefully concealed irom sight irom the bour 0: its arrival on board at Nov foik till after the departure of the vessel from Fayal, and then only seen by two coal- heavers, and never reported, but stowed away und cover- ed with about forty pounds of hemp and teit in a litte dark cuddy below deck, two feet wide and five or #x long. ‘Ihe testimony of these witnesses, who say th saw it, was so entirely contradiciory as to give their evi- dence but little if any weight. Many other witnesses swore, someto have searched the 100m and others to have often looked into it, yet they never saw any dem!- johns. The probability is that the turpentine was never put in this place until aday or two belore the veesel reached Gibraltar, aud was tlien purposely 80 covered up by hemp as to defy observation. A neglect of duty im some of the subordinates in not stowing it away proper ly, in the first place, rendered in their minds a conunne- tion of conceaiment of the fact necessary. That the Captain knew not of its existence was evident to all On this point the testimony was clear, fuil, and conclusive. Having traversed over the wide field covered by the charges, (likened by his counsel to ‘a wide-cast n t from Nortolk to Gibraltar to catch him in its toils”) and pomt- ed out the suare which had been laid for bim in the tram- ing of those charges, (one specitication charging bim with committing acertain act and another with not committing the same act, thus making both the omission and commis- sion criminal,) and congratuiating himself that the neture of the evidence adduced by the prosecution alone enebied him to escape both horns of the dilemma, he concluded by slightly aliuding to his Jong service in the navy, (six and thirty years.) aud then suid that, while the pages of country’s history were emblozoned with the deeds of the immortal Lawrence and gallant Biddle, he who had stood + by side, and participated in the capture of the Peact d Penguin, wast nal before a court fora constructive offence; and ended by saying that to men so sensitively alive to the honor of their country os tiom their professions and their deeds were the members of the court, he fully confided his own honor. Thus terminated an investigation which cannot but bring ont in bolder relief the charect:r and conduct of one whe in public or private lile has ever been, in the st ictest sense, an officer and a gentieman.— Washington Letter, Oct. 10. RepeaL Ourrace in Quesec.—It is our painful duty to record the perpetrauion of some disgraceful outrages in Chumplain street, on Tuesday evening last. About 8 o'clock, a mob, variously estimated at trom 300 to 600 persons, bearing with them two blazing tur berrels (taken from Mr. Jones’ whurf) and shouting tor “ O'Cen nell and Repeal,” paraded this street, breeking the wine dows of every Louse in which no light was visible— ‘This destruction was indiscriminate ; Catholics, Protess tents, Repeaters and Anti-Repealers, suffered alike; and the windows of the Catholic Courch, the Mariners and Wesleyan Chapels, wherein no lights could have been expected were demolished. Huge stones were burl ed for this purpose of destruction ; in several instances breuking sash and panes, At Johnson’s tavern, the damage inflicted was very great, and so incensed was he that, after warning them to desist, he fired end wounded one man in three places, with small shot—a sailor, of the Clio, we are told They returned here sgain at 10 o'clock, menacing his life, when he again fired, wounding ano- ther person. Mr. Leek, at the Cove also fired, ond while preparing to give a nd shot, was knocked down by stove thrown a. him, itis thut three persons been wounded, but none seriously Connoll J. P., endeavored to disperse the rioters, but cow not succeed in doing so ; he, however, persuaded them, when @bout to retire, to throw the blazing barrel, which they had thrown down onthe wooden pavement, in Sous-le-Fort street, over the Wharf; in so doing they were nearly setting fire tothe steamer Charlevois, The police were too small a force to contend with the rioters. Yesterday evening « company of the 43d Light Infantry marched down to the Queen's Wharf to suppress an ex- pected renewal of these scenes of violence, but their servi- ces Were not required. We are informed that the actual Repealers were not in any way connected with this riot, and ure glad to find, by the resolutions of the Association given elsewhere, they have promptly vindicated their in- nocence, and boldly denounced any of their associates who may be detected to have been implicated.
