Kissam.—This case was resumed tha morning, when Mr. O'Connor gre~ plied on part of the plants. In 1836, the plaintiff, Mr Vorreat, it appeared, agreed to purchase a lot of land and erect a mansion house, at New Rochelle, for rt named Leggett Defendant was brother-in-law to Leg- gett, and erected the building. He charged $6000, De tundant refused to pay on the ground that the amount war larger than the contract, having already paid $4100. The case was referred, and Leggett, in bis testimony, stated that Mr. Forrest had agreed to erect the buildin, feiendship. Kiswam agreed to do the work for i kee: t moved into possession before the house was finished, the ruferees not having come toony decision. Leggett died in the Interim. June 4, * Batra Ovrrace.—On the night of the first day of June inetant, between the hours of nine and ten o'clock, Polly Molius, a married lady of Germantowa, in this county, while going home on the highway, wa: violently assaulted by Henry Lada, a near neighbor and hrother-in-law to Polly. Ladu’s wife was unwell, and by his request, Polly had called at his house to remain with his wile, during his absence from home a short time. Lada returned a little past ten o’clock in the evening, und appeared to be intoxicated ; soon alter which, Pol} started to go home a distance of about a quarter of a mile and had gone but a fe ‘when Ladu came out of bis her to come again on the morrow to bake ; he then suddenly came up to her, caught hold of her and attempted to throw her upon the ‘struck her, then took a pocket, po-ket and cut her throat in a fright: .
