Provision in re ard to the State, and is to be construed in respect to New ‘ork in such @ manner as not to be inconsistent with the other statutory provisions on the subject, and inasmuch as the Legislature have divided the buildings sppropr ated for these purposes, and appointed different persons to have charge of them, the distinction is to be observed througheut; and therefore the county jail intended by that provision in the city of New York, would be that building or juil set apart for the confinement of offenders, and not that provided for debtors. An objection, how: ever, is made to the jurisdiction of the officer under this writ, because it appears that the Sheriff holds the peti- tioner as @ prisoner under and by virtue of certain com- mitments issuing out of the Court of General Sessions, founded upon convictions therein. ‘The statute provides that such extracts duly certified shall be sufficient authori- ty to the Sheriff or other officer to execute the law These extracts or certificates are duly made out,and would afford mple justification to the officer to hold the prisoner if he had the power so to do. The mere transcript of the entry of the conviction, and of the sentence, is all that is required, and itis not therefore necessary that in addition thereto there should be acommitment to any particular officer. The officer, whose duty it is to keep prisoners, is required oy the statute to receive and keep them on receiving suc! certificate. These cer- tificates can be obtained from the clerk by any per- son on application, and when it is apparent that the has not authority to detain the petitioner under this oceeding, 1 am ef opinion that such a case relief ould be granted by habeas corpus. Any other rule would leave the prisoner in custody of any individual who chose to get edd of this certificate from the clerk, and then arrest the individual so named in the conviction, and detain him as a prisoner without any authority whatever, Under these views I do not feel authorized to ref charge from this imprisonment by the Sheriff suggested that in case un order was granted discharging the petitioner from the jody of the sheriff, it was the duty of the officer to remand the prisoner to the custod: of the person who had # right to such custody. Such the rule where it day ony that any one is entitled to such custody. No such fact appears in this case. There is no evidence of the prisoner's having been in the custody of any other person, or that there is now any authority from the court to any person to detain him. The presumption in that he has been legally discharged by the person who had such custady, and until the contrary is made to ep- pore by testimony, there is no evidence that there is any iegul cause ofdetention. If he has been im; properly die churwed by the efticer who should have detalned him, the Court has ample power to cause him to be re-committed. An order in conformity with this opinion was then sign- ed by the Judge, and Mike was discharged.
