The _ perjury charged is in the alleged declaration of Stratton, made before the magistrate, that he had actually seen some registered bills of the Union Bank of New York, obtained from the Pomeroy trunk. An examination was held in the matter at Rochester, day. Buchan, the magistrate who issued the warrant, testified that Stratton came to him on the 2nd of January, and stated that a person named Gilbert H. Moore, who was in his employ as a spy upon counterfeiters, had discovered the perpe- trators of the Pomeroy robbery, and that he had re- vealed to him the whole matier, and showed him one of the Union Bank sheets. He had several conversations with Stratton, and always understood him to affirm that he had seen the bills. This fact was the basis upon which he issued the warrant, and he telt certain that Stratton had sworn positive- ly upon this point p Gilbert H. Moore, the stool pigeon, alluded to above, was also examined, and his testimony fur- nishes the best history we have yet had of this e: rious affair. We copy it entire from the Kochester Democrat :— Gilbert H. Moore testified that on Monday morning, the lst of January, {he came to Stratton’s room, at Morton's, and communicated all the information he had obtained in reference to the robbery. He stated that he bad become acquainted with a woman (Mrs, Leggett) then staying at the United States Hotel, who had revealed the whole affair tohim. She said her business here was to sign some $60,000 in bills of the Union Bank. A portion of these bills she had, which were obteined from Mr. Banks, in Buffalo. A person unknown had called at her house in that city and engaged her to sign the bills. A day or two after Banks called, bringing two blank sheets with him, and made arrangements to sign the whole lot, but that in con- sequence of some excitement among the police officers, in reference to searching Banks's baggage, it was not consi- dered safe, and they concluded to do the business at Rochester. She expected to receive the sheets from seme person at Batavia, but did not. She desired Moore to procure a pri- vate house where she could sign the notes with safety.— With Rust she pretended to be well acquainted, having of- ten stayed at his house—she having also seen him falo, She had always considered him “one of their of folks” as he had been engaged in counterfeiting for years, With reference to the robbery she told Moore that Rust and Banks had taken the trunk from the boat, and carried it to the Astor House. » next day, however, she said the “ Howard House.” ‘The trunk, papers and drafts were destroyed. Moore told her she had no cause for fear. - She then told him that Rust had made an appointment with her at the theatre, and she and Moore went there in the evening, where she told him that Rust and Banks came in and stayed about fifteen minutes. Next morning after the visit to the theatre, she went out after breakfast, and stayed till eleven in the forenoon. Upon her return she told Moore that “ she had a mind to get mad. Rust must be a fool to suppose that she would follow him all over the country. He had got frightened, and left the city in a private conveyance the evening pre. vious, after the theatre was out, aud had taken the sheets with him She expected to meet them next day near Canandaigua, Rust and Banks had left word for her to follow them in the next train. But when questioned under oath he said he never saw any bills whatever, and that he only told Stratton so to make the story a “little stronger.” He made this same as- sertion afterwards to others, but retracted it in the broadest manner under oath. On Thursday, Jan. 4th, she wrote a letter to Rust, and gave it to Moore, open, requesting him to fold, addr and mail it. Instead of so doing he took the letter to Col. Soctrry.—In speaking of the cert of this Society in our yesterday’s paper, we were only able to report its great success; to- day we with pleasure devote time and space to a few more remarks: as we opine this Society is destined to form an important era in the cultivas tion and appreciation of classical concerted yocal music in this city. In former numbers of this pa- per, we spoke in most encouraging terms of this Society, the first concert of which, at Washington Hotel on Friday evening, more than justified all our remarks. ‘The programme contained prinei- pally the glorious compositions of the old masters, such as Wylbie, Festa, Orlando Gibbons, Merenu- zio, &e., with the modern compositions of “Spader of the Heroes,” by T. Cooke; and that father of ge . “* When winds breath soft,” by the immortal Vebber, the gem of the evening, and mest r. turously encored, which it richly deserved—it beautifully sung ; so also was “ Down in a flowing vale,” by ta, the delighted audience de- manding it. four tim many even requiring it even a fifth time; we gave the words of this Ree but charming composition in a former pay Ve now give an equally beautiful one by O. More geese than swans now live, more fools than wise!” ‘The concert was a delightful one, which all who ere present will testify to, and those who were ibsent had better enroll their names, as the society is an exclusive one, and only admits members to the concerts. In conclusion, peculiar credit is due to Rosier, A. Phillips and Geo. Loder, for their excellent conduction, and also to Mra. Hardwick, who sang in a manner to convince every one that she enjoyed the rich banquet of music performed Indeed allt members exerted themselves suc- ssfully. We observed Doctor Wainwright pre- ent, looking as calm and delighted as if no such thing as Potts and Kettles were in existence, ex- cepting, perhaps, “kettle drums.” Conon PLEBas famsley vs. Gray.—Having observed an editorial article in this morning’s Sun, published by M. Y. Beach, pretending to be a re- port ina « between Wamsley vs. Warren C. Gray,in the Court of Common Pleas, wherein | was counsel for the defendant, it is but just and proper to inform the public that | have a libel suit against M. Y. Beach in the N. Y. Circuit Court, and that it was yesterday (Friday) expected the same would be tried this (Saturday) day, and that it is now in- tended to try the same on Monday next, the 22d instant; and that I believe said article was publish- ed (by Said Beach,and not by Mr. Davis, the worthy reporter of that paper, Who informs me that he did not report the case) prejudice me in my suit against him, said Beach.
