Joxss.—The brig was in a most extraordinary condition, one requiring ten-fold more punishment than ordinarily necessary. As a matter of justice to Captain McKenzie, his communication should be placed on the minutes. Juper Apvocats.—1 do not object to the statement made by Capt. McKenzie, andthe Court may make what order they please. The only point in which I differ is whether the proceedings properly belong to this record. Under the direction of the Court I gave the log book to Mr. Perry, with the order to retain it in his possession, and keep it in the same state in which it was produce until it would be again required in Court. Mr. mis understood my order, and left it on board the Nerth Caro- lina. Yesterday, or the day before, as soon as I found it was here, | asked Capt. Gregory to keep it just as he has had other papers of mine in his custody ; but when or how access has had to it, and by whom those extracts have been made, I am of course altogether ignorant. Capt. McKes: I submit to the Court, whether it would not be proper to order an immediate investigation for the purpose of discovering what officer of the United ‘States Navy has made such extracts from my log book, whilst | am submitting toa solemn iiquiry. It must have been done through the ng of an officer. Jupce Avocate.—That might be « very interesting inquiry, but it would be making usa court of inquiry into matters entirely out of the record, and is of courseout of the question. Capt. McKewzre.—The henor of the Navy is concerned in the discovery of that officer. - Com Stewaat.—l of course = agree with the Judge Advocate. He would betravelling altogether out of the record by undertaking any such inquiry. If any bad impressions have been made, by newspapers, the injured has access to the same channel of communication with the public, and can through it, set the matter right. The following reply of the Court to the communication ofCaptain McKenzie, was then read by the Judge Advo- cat employ of Harrott, about two weeks before Lyons came; Harroit employed me and got $90 from me ; the advertise. menta were published in the Sun, and I answered it by writing a letter to A. B. or A. H.—he was to pay me $30 & month, and said thet he was the owner of vessels on the sea; 1’ was engaged as clerk, andthe ranners were to bring in passengers, which I was to send away ; the run- ners found one. Q—What did you do with him ? A.—Ha—(laughter)—Daley sent him to Liverpool. The defence called about twenty witnesses, among whom were the John Smiths, the Bob Jones’, the Charley Browns and the Peter Johnsons, but none appeared to an- wor The jury, without leaving their seats, returned verdict of guilty, and the Court ordered him to be remand- ed for sentence. Trial of Laurence K. Stevens—This man was tried on acharge of grand larceny, for stealing a silver watch, $15 95 in money and two shawls and a pair of pantaloons trom Robert McCorley on the 10th of December last. Mr. Abrahams, pawn proker, testified that the accused pawn- edthe two shawls and the pantaloons at his stare for 78 cents. The jury returned a verdict of guilty of peti ar- ceny only, and the court sent him to the penitentiary for ix months. Forfeited Recognizance—The name of Smith Reed, tailor, formerly of Middletown Point, N.
