We learn that some of the individuals alluded to, did attempt a farce of a peculiar kinJ, but being discountenanced by the remain- der of the jury, who were respectable, sound-judging, honest and ) et humane men, they were defeated in ther designs. On the whole, we think that their verdict is a most righteous one, and will meet with universal approbation. There was no doubt that Alexander killed Lougee—there was no evidence to show “malice aforethought,—it was not satisfactorily proven that he was insane—und ye' it der some peculiar mental excitement. In this view ol the case, the prisoner could not have been convicted of mur- der either in the first or seconu degree—nor yet could he have been acquitted as innocent. Before the jury came in, Alex- ander sat there, pale, agitated, absorbed, his face indicat- ing the most violent mental struggles between a determi- nation to look firm, anda soul-sickening apprehension of his fate. Judge Barton took his seat. Shortly after the members of the jury made their appearance, and as one by one they entered the box, the face of each wearing an pect of solemn and fixed repose, the agitation of the pri- soner became intense, His counsel attempted to distract his thoughts by conversation, but with little effect, His countenance flushed and grew pale by turns, He moved uneasily in his seat. His eyes were thrown frantically about and his whole system seemed laboring under exces. sive nervous excitement. ‘The Court were waiting for the entrance of Judge Conrad,and the horrid suspense at length falling back in his seat he would have feinted but for the rompt action of one of the officers of the Court, who indly presented him with a glass of water, which appear- ed to relieve him much. Judge Conrad came in. The crier opened the Court. gan to evince astirred up sympathy. “Gentlemen of the ury,” suid the Clerk, his Voice tremulous with ill-con. cealed emotion, “have you agreed upon your verdict ?” The foreman, Mr. Kerr, rising with the bill of indictment in his hand, replied—the words half choked in their utter- We have.” “Juror, look upon the prisoner-—prisoner look upon the juror. Alexander guilty of the foley. of murder whereof he stands indicted, or not guilty Here the prironer, who by a convalsive movement, af- ter one or two ineffectnal efforts, had sprung wildly to his feet, gazed at the foreman of the my, with an eye full of desperate energy, and a look that hetrayed a world of ago- nizing and conflicting emotion. Tic stood trembling in every limb, his left hand convulsively grasping the table seeking some support to keep him irom oor. The foreman answered ina clear, distiact, audible, and htly agitated tone— é find him guilty of Manslanghter.” All was silent as death. Suddenly the ominous quiet was broken by one loud heart rending sound, something sob and a shriek, and the prisoner fell back in ling to the ‘he foremen continued— “ Not guilty of murder in the first d not guilty of murder inthe second degree—but guilty of manslaugh- jer.” Here the prisoner's aged father was overcome and wept aloud and bitterly. . The prisoner's brother also burst into tears, and then ensued probably one ef the most affecting scenes the court room has ever witnessed. As wecannot scene lasted for at least twenty minutes, the prisoner, his father and brother, with white handkerchiefs to ir eyes, sobbing and moaning in the most distressing manner, their friends, acquaintances, and the counsel, endeavoring in vain to console them.
