That is t> say, the party now in pow- er have declaret opposition to the existing system, but the law passed last winter, commonly called Latham’s Jaw, prescribes conditions under which banks may ob- tain charters. The practical operation of thel.w may be best expressed in the following answer of the Ohio Life and Trust Company to the question whether it had applied for a recharter under that law. The President smade answer as follows :— 1st—That neither he, nor the stockholders, would ac- pt such acharter if they were made individually lia- « vi |—That the trustees of the institution only applied for arter in general terms, without any reference to the banking law, and that that was the only authorised me- morial offvred. 34—That Mr. Williams. on his own responsibility, find- ing that no charters would be granted, proposed that the Ohio Life and Trust Company shoul! be included under this law, leaving its acceptance to be determined after- wards by the trustees and stockholders of this institu- tion. ‘The reason for this step was twofold— First—The institution is peculiar in its organization. It has two departments—one called the banking, the other known aa the trust department. The latter, Mr. Williams considered as the stockholder of the former, and con: quently that if he accepted the charter under Latham’s bill thestockholders of the trust company could not be individually liable. Second—Whether right or wrong in this view, the trustees could determine whether they would accept it, if they refused, no harm was done—if owing to this peculiar organization to which we have referred, they could have accepted, why something might be saved to the compa- ny. The material objection ia the individual responsibility of the stockholders. This is the English joint stock prin- ciple, and is the only one by which the public may be assured against loss. In the English banks, one stock- holder has the power to demand and compel a liquidation of the concern. as soon as he is satisfied that 25 per cent of the capital is sunk or lost. This keeps all vigilant, and instead of the utter neglect with whieh the affairs of a bank in this country are treated by stockholders and many of the directors, thereby throwing the whole con- trol inte the hands of a few designing men, they all look after the welfare of the association, in order to protect their individual property. It appears, however, that the Ohio stockhoidersYhave so little confidence in their mana- gers, that they will not trust them beyond the amount of stock subseribed. Why, therefore, should the public trust them? The prospect, then, is that next year the board will be swept clear, and Ohio will, in regard to currency, be placed on a good foundation. ‘The advocates of the paper system say that it is, neces- sary to develope the resources of the country, and to facilitate the forwarding of produce to market. In 1836, the circulation of the Ohio banks was near $10,000,000 ; the present year it has averaged but little over 1,000,000, or 10 per cent, In {1837, consequent upon the high cur- rency of 1836, there were imported into the United States, 1,600,000 bushels of wheat, valued at $4,000,000, for which *pecie was sent abroad. This year the export of flour will reach $11,000,000, for which specie is flowing into thecountry. Cannot the farmer see in this simple opera tion of trade, which system operates most to develope the resources of the country? Is he benefitted that foreign wheat is brought and sold at his own door at a profit, and the proceeds in specie taken out of his pocket and carried to Odessa in payment, while he is dreaming of litho- graphed cities, town lots, and bank dividends? The present movement of specie from Europe to New York, snd from New York throughout the South and West, enriching the country with a sound and copious circul: ting medium. ‘The prices of produce are indeed very low; but that is caused by the abundance of the supply, the developing “of the resources of the country,” under the specie system. The drawing off of that surplus, in ex- change for thespecie, will raise the value of the remain- der more than equal to the whole value of the specie im- ported. The repletion of the currency will accelerate the rise; but when specie shall no longer be a profitable article of import, the export trade, or the foreign vent for produce, must cease, unless foreign goods, at a fair reve- nue duty, are taken in exchange. This can only be done by an amelioration of the present tariff, without which, all description of agricultural produce must become value- less. ‘The late taritf imposes a duty of near 60 per cent on foreign woollens. The farmers were told that this was to raise the value of their wool.
