The committee of the board of brokers appointed to de- liver a public opinion om the conduct of Messrs. Boor- maan, Johnston & Co., will probably report in a few day ‘There 1s a strong feeling among mercantile men, which, probably, will also end in an expression of public opinion, to save the honor ef the city from the discredit thrown upon it. It is in vain for commercial men to affect to ’ rown down repudiation at the west, by refusing to trust people coming from a repudiating State. Those persons may well answer, that although positive dishonor has not yet overtaken the public securities of the City and State of New York, yet they cannot stand on a very secure foundation after repudiation for legal quibbles has reached the grade of her first merchants, lawyers, and bank presi- dents. It is true, that none of the firm of Boorman, Johnston & Co. are Americans, but they should be made toconform to the usages of the community in which they live. When Mr, Biddle, some years since, statedfin one of his famous letters, “ that the only reason which made the New York Banks continue specie payments, was that the law was imperative upon them,” we looked upon it as the sneer of a disappointed financier, from whose grasp the prey had escaped. ‘The late decision of Mr. Newbold, however, goes too far to prove that Mr. Biddle‘was right ; that honor, integrity, or sound psinciple, had less to do with the matter than the behests of the law. When the auctioneers and jobbers held a meeting at the City Hotel on the 26th October, 1939, with John Haggerty, Esq. in the chair, to request the banks to suspend, extend their discounts, and take safety fund money at par, the Bank of America made answer that “they would do all they can to relieve the merchants, but must continue te pay specie.” We hoped that the obligatiento pay arose from a moral senso of duty, but now it appears it was only a le. gal obligation. Mr. Newbold, and his direction, Johnston and others, stood looking over the barrier interposed by the law between their bank and dishonor, with longing eyes, into fields of insolvency and depreciated paper, where these jobbers were alluring them to come. They eagerly examined the law, but found, it too strong,and they dare not venture. Boorman, Johnston & Co. assisted by Mr. Smith of New Castle, Kentucky, have found a flaw through which they can creep out of their engagements, and yet keep under the shadow of the Jaw. When Mr. Boorman is applied (o fulfil a claim, just in equity, he with trembling hand, and a true Shylock chuckle, ex claims “it is not in the law,” “I cannot find it in the statute.” He proclaims to the world that he will do no- thing without “ the Jaw,” and in this he is backed by the Bank of America. Dealers coming to New York are, therefore, to understand, that they must do their business with a half dozen lawyers at their backs. Woe be to the Juckless wight, in whose contract a legal flaw may be dis. covered by the retained council of “ hi igh minded” mer- chants, and their principals. All this is to be counte- nanced by thecommunity. Time was when a map, whe obtained money of his neighbor at the market price of the day on his obligation, and then went forward and put ina plea of usury to avoid paying it, it was thought not quite the thing—indeed, a little dishonorable, and in fact some rigid moralists might say it was no better than picking pockets, yet in perfect accordance with the law. Here- after, however, no disgrace is to attach to any transaction that keeps within the pale of the statute. The conse- quence of such progress in morality, is a fruitful matter of reflection for the business community.
