Parvoned.—Through the influence of T. J. Smith, Esq, the young man named Thomas, who was found guilty a few weeks since of breaking into and robbing the shop of Mr. Sandford, baker, and sentenced totwo years in the ‘States prison, the Governor has issued a pardon. Staples, ‘the brother-in-law of Thomas, who was concerned in the robbery was acquitted at the trial, through the ingenuity of hiscounsel, Mr. Smith, although he had confessed the crime when arrested. Misstxc Man Founn.—The body of Daniel C. Meltz, a native of Maine, aged 33 years, and a plasterer by trade, who left his home in Twenty-first street, on the 3ist of March, while in a state of partial insanity, arising from religious excitement, was found in the Hudson ou Satnr- day morning. He has a wife and child residing in Kitte- ey, cae county, Maine. The coroner found no marks of lence upon his body, and it is therefore presumed that he must have committed suicide by drowning himself while in a state of derangement. How to Ger a Notre to Discount.—Go to your friend and tell him you wish his note for $100 for three ‘months, to get discounted, and agree, ‘money, yon will place the sum in his hands on condition that he will loan youa portion of it. At saan solicitation, he consents, and sends a boy with you to bring the money back; then manage to get the note from the boy, and keep it, or get it shaved for any amount possible to raise. Officer Tappan was selected to do up the busi- ness, and succeeded yesterday in arresting the parties and recovering about $100 worth of table linen, sheets, &c. from the premises where he found Steers at Newton, L. AN INFANT DROWNED IN A TUR OF waTeR.—An infant ‘child of James and Harriet Willock, residing in Fifteenth street, while asleep and alone on a bed, where it had been placed on Saturday, accidentally rolled off into a tub of water that was near fit, and when discovered by its mother, was found deprived of life. Verdict of coroner's ju Seostiewy: pitH FROM Erityrsy.—An inquest was held on Sa- turflay, on the body of a man named Cornelius Pool, a na- tive of Long Island, and a currier by trade, who died very suddenly on the same day from fits of epilepsy. Court Record. The May Term of the Supreme Court of the State of ‘New York will commence this day, in the Board of Al- dermen’s room, City Hall. The court will consist of Chief Justice Nelson, and Judges Bronson aud Cowen. The Calendar contains about 350 causes. The May termof the Circuit Court and Court of Oyer and Terminer, willalso commence this day in the City Hall. There are about 220 cases on the Calendar. S This week will be appropriated by the Judges of the Superior Court to the ne of arguments. Next week jury trials will again proceed. ‘he Common Pleas hold two courts, one in its own room the other in a room of the Superior Court. Superior Court. Before Judge Tallmadge. State of Indiana vs. Dwight Danforth.—General Milton ‘Stapp, jate fund commissioner of Indiana, when in New York, made the office of Danforth & Co., brokers, Wall street, his place of business, They were indebted to the State for stock, which had been sold to them by one of the associates of General S., in calling for settlement of which led to the introduction. The General frequently left bonds with them to be placed for safe keeping in their office trunk and vault. On going west in the spring of 1940, he left with Mr. Danforth, in the same way, 15 bonds of $1000 each. It was internal improvement stock, dated in 1933, payable in 25 years, and ring interest at the rate of 5 per cent per annum. The bonds were signed by Isaac Coe, James Varrington, and Caleb B. Smith, eleven of them numbered as follows :---3795, 3796, 3903, 3310, 3311, 3922, 3993, 3924, 3527, 3940, 3841. The numbers of the others the General, in giving his testimony, could not recollect. In July or August he returned and’ asked for the stock, but Mr. Danforth told him that it was not con venient just then to give it to him. The free banks being at that time going into operation, Mr. D. asked him to Joan him, for a short time, a lot of sterling bonds, so that he might hypothecate and meet some little inconvenience that existed. The General did so, and they were after- wards returned. Subsequently he left 30 more bonds of $1000 cach, in the hands of Mr. Danforth, “to be taken good careof.” These he also afterwards demanded, but * they had been placed promiscuouly with other stock in possession of Mr. D., and unintentionally used.” Here was @fix. The General had left the office of fund commis- missioner, and was anxious to settle up, and was bound to account for this $45,000 worth of stock. Finally, he took h C. L. Coles as security} for the 1 ayment of the amount to the State of Indiana, ith pena ty for non-performance in the sum of $79,000, This document, however, the State would not recognize, contending that General Stapp had left the office of com- missioner, and was not,authorized to receive it. The pre- sent action for Trover, therefore, is brought against Dan- forth, to recover the value of the face of the bonds. Mr, Benjamin F. Butler, late Attorney-General of the United States, and Mr. Josiah Howe, were counsel on the part of the State, and Messrs. 8. Sherwood and R. W. Townsend, for defendant. The question presented itself whether the bond was valid, and cancelled anterior operations and lia- bilities of all parties, or not. The Jury, after a two day’s trial, decided in the negative, giving a verdict in favor of plaintitf for $47,993 95 Marine Court. Before Judge Sherman. Arnit. 30.—Samuel Ross vs. Abijah Matthews.—The lady of the defendant had encountered, like many others, the misfortune of losing her teeth. ‘The plaintiff made up the deficiency by supplying her with aset which would masticate a Cannon ball, and renew in addition twenty years of life in the way of youth and beauty. For this he charged only $100, and now brings suit for the recovery. On commencing a suit at law, the rule is, that a plaintiff is bound to include every claim he has against a defend- ant. Anything omitted in such suit is cancelled. The defence in this case is that Ross sued Matthews in the Common Pleas last summer for a debt due, and recovered $90, that this $100 was owing, and payable at the time; was not included in the bil and the plaintiff, therefore, cannot now recover. To rebut this, it is averred that the 100 was not due then, time having been : -ord- g to agreement, in which to try the teeth, and see if they would do their duty. Verdict for plaintiff. A good business has been done generally in the different markets since the opening of the canals, and the receipts of produce have been pretty liberal.
