T a1 1CLE & | THERF fhall be a firm peace and friendfhip be- tween all his Majefty’s fubjets of this province, and the nation of Indians called the CunerokEers, and the faid Cherokees fhall preferve peace with all his ma- jeRy’s fubjects whatloever. II. THr articles of friendfhip and commerce con- cluded by the lords commiffioners for trade and plan- tations, with the deputies of the Cherokee nation, by his Majefty’s command, at Whitehall, the 7.0 day cf September, 1730, fhall be ftriétly obferved for the time to come. ITI. WuereAas the Currorit Jndians have at fun- dry times and places, fince the 19th of Noveniber, 1758, fliin divers of his majeftys good fubje&s of this pro- vince ; and his excellency the governor having demand- ed, that fatisfaCtion fhiould be given for the fame, ac- cording to the tenor of the faid articles of friendfhip and commerce abovementioned ; in confequence whereof, two Cherokee Ixdians, of the number of thofe who have béen guilty of perpetrating the faid murders, have al- ready been delivered up to be put to death, or otherwile difpofed of as his excellency fhall dire€t: It is hereby fSpulated and agreed, that TwenTty Two other Che- rooke Indians, guilty of the faid murders, fhall, as foon gs poffible after the conclufion of the prefent treaty, in - like manner be delivered up, to fuch perfons as his ex- cellency the governor, or the commander in chicef of this province for the time being, fhall appoint to receive them, to be put to death, or otherwife difpofed of as the faid governor, or commander in chief fhall direét. 1V. Chemobe, Oufanatah, Tallichama, Tallitabe, Quaraalattabe, Connaforatab, Kataeroi, Otaf- fite of Watago, Oufanolitab of Jore, Oufanslitab of Cow- etche, Chifguatalone, Skiagufia of Sticowee, Sanasefie, Woeabatch, Weoeyab, Oucab, Chikanab, Nicholike, Tony, L otaiab hoi, Skalilefke, Chiflz, fhall remain as hoftages - for the due performance of the foregoing article, in the cuftody of fuch as his excelleney the governor fhall pleale to nominate for that purpofe ; and when any of the Cherokee Indians guilty of the faid murders, fhail have been delivered up, as is exprefled in the [aid arti- le, an equal number of the [aid hoftages fhall be forth- with [et at Liberty. V. IMMEDIATERY after the conclufion of this prefent treaty, the licenced traders from this government, and all perfons employed by them, fh-ll have leave from his Excellency the Governor, to return to their refpec- tive places of abode in the Cherokee nation, and to carry on their trade with the Cherokee Indians in the ulual manner, according to law. VI. Durinc the continuance of the prefent war be- tween his moft facred Majeity and the Freach king, if any Frenchman thall prefume to come into the Cherokee nation, the Cherokees thall ufe their utmoit endeavours to put him to death, as one of his Majeity’s enemies ; or if taken alive, they fhall deliver him up to his Excel- lency the Governor, or commander in chief of this province for the time being, to be difpofed of as he fhall direct. On Tuefday laft the three Cherokees de- livered up o the Governor in Confequence of theTreaty concluded between his Excellency and that Nation on the 26th ult. and allo Charles M‘Gunningham, arrived in Town, under a ftrong Efcorte of Independents snd Proviacials. And on Wednefday the militia of this town ceafed doing duty ; being relieved by the faid independents and provincials ‘ The lalt accounts from Keowee, are, that the fmall pox has deftroyed a great many of the Indians there 3 that thofe who remained alive, and had not yet had that diftemper, were gone into the woods, where many of them muft perith as the Catawbas did ; and that ano- ther murderer, called Scalp Jack, of the Town of Toxaway had been delivered up to the commanding cflicer at Fort Prince George, in purfuance of the late treaty. The following is an account of the misfortune that be- fell his Majefty’s thip Mermaid on the 5th inftant, and of her fituation on the 10th ; as given by Capt, Hackman him/elf. ““ His Msjefty’s thip Mermaid under my command,’ failed from Charleftown the 1ft inftant, with a pilot for Providence, having Governor Shirley on board, ard orders to land him at Providence ; but unfortunately on the 4th day, at § o’clock in the morning, we fell in with the Jand and breakers all about us, fo that we could not clear them any way, therefore were forced to come ' SR IR e e Gen.
