Burrows, of the United States District court here today filed a decision favoring James J. Walsh and Robert O. Eat- | on, former and present collectors of internal revenue respectively, 1n uits brought against them by %ha | F. Warner of Bridgeport. The vlaln- 1iff brought suit against the collec- | tors personally to recover taxes paid, in one instance to Collector Walsh during 1919 and 1920 on an annuity which she made na claim for until March 1925, Judge Burrows declares that the ease of Fox against Edwards, 287 Federal 669, clearly settles the law for this ecircuit in Iding that where the payment was voluntary, there can be no recovery. The plain- tiff asserted she made payment with- out full knowledge of her rights. Judge Burrows answered this con tention wtih the legal precept t ve law and if he voluntarily makes payment which the law would not compel him to make, he cannot aft- erwards assign his ignorance of the law as a reason why the state should afford him legal remedies to recover it back.” ‘The ruling differs from the ruling of Judge Edwin S.
