C, June 22 Sentenced to 30 years imprisonment for am assault on a white woman and pardoned, after nearly 13 years, on the sworn statement of the wom- an herself that he was innocent, Bien Bess, a negro, was back behind the Bars today while state officials considered what could be d out a pardon issued under a n purehension, Taking the woman’s affidavit in ~ovod faith, Governor John G. Rich- ds said he felt he could not have acted otherwise, but now, she de- clares in a second affidavit that she never intended to s: Bess was not guilty, She cannot beyond signing her name, and says that In the original instrument she intended merely to convey her for- giveness to Bess and thought that was what the document suid when she signed it. The sccond affidavit was present- ed in the course of a grand jury in- vestigation ordered by Gov. Rich- ards, The jury reported yesterday that there was “nothing in the evi- dence” to support the contention made in the negro’s appeal for clemency that he had been wrong- fully imprisoned. The county authorities have re- ferred the case back to ernor and the attorney general of the state asking advice as to what steps should now be taken. pardon, which was issued months ago, is held to be irrevo- cable, and it is contended that to bring Bess to trial again would con- | stitute “double jeopardy.” Meanwhile, the state penitentiary tody, for fear of mob violence after the report of | the grand jury.
