6.0, P, INTENAS TAKES 115 STAND First Primary There to Be Held in July Dallas, Tex, March 12 (#—~Pocu- llar quirks ¢! the Texas primary law are glv'ng trouble to the Re- publican party which, for the first time in its history, is planning to hiold a pariy primary in this state. The first primary is next July. The law requires that any party polling 100,000 or more votes for governor shall hold a primary. In the last general election, George C. Butte, Ropublican candldate for gove ernor agalnst Mre. Mirlam A, Fer- guson, recelved 800,000 votes, three times the vote over polled by a Re- publiean candidate, A dispute has arlsen as to which party is to have the use of the bal. lot boxes, voting booths, and guard ralls. The law provides that these supplies may bs used by the party casting 100,000 votes in the last preceding, general election. A formal demand from the Re. publicans fer the suppliss placed county commissioners' courts in a quandary., Some countles have met ke situatlon by purchasing double sets of boxes, booths, and guard rails, while others have attempted to evade the demand. One of the chief dlfferences be- tween the Texas law and the prim- ary 1aws of other states is that the former does mot provide for a joint primary, 1f more than one party comes under its provisions, the parties hold separate primaries on {he same day at different polling places. The Democratic party is the only one which has ever functioned under ‘his law and Republicans are charg- ing that it 's a Democratic law made by Democrats for Democrats. T'nlike the joint primary operated by the state, with the same officials at the generil election and in which ters of bcth parties partieipate ing ballots of different color and design, the Texas law provides for partisan prmaries, conducted sep- arately. Each has election officialy solected by the party county chair. men and with no officlal responisi- bility to the state for safeguarding the primary er protecting the count other then a possible appeal to the courts alter the primary is over. The primaries are financed by the candidates, the chief burden falling on candidates for county ang precinet offices. These candidates are assessed on the basis of the pay | attzehed to tha office’ they seek. didgtes for state and district ofices are assessed about $100 each. The Republicans declare that this {3 in effect purchasing the office, and that it is a pecullar hardship on them, because it is.almost impossible to induce a candidate to contribute o a hopeless cause. Heretofore =& Ropubiican candidacy in Texas has heen an empty honor, with here and here-an exception. The law pragides that every hour an election judge must go to the door of the polling place and announce in a loud voice the numbér of bal- lots cast up to that time.
