JAIL ADDED PENALTY Marinchak, Tree Chopper, Gains| Nothing by Filing Appeal John Marinchak of Road, who was fined $100 and costs when arraigned in the New Britain police court in October on a charge of injuring shrubbery, was fined. $100 and costs and given a three months' suspended jail sentence by Judge Haines in the superior court at Hart- ford this morning. * The case was heard yesterday afternoon, but de- cision was reserved until today. At- torney William F. Mangan appeared for the accused man. Mrs. Eva Manelga of 29 McClintock Road testified that Marinchak de- stroyed 16 apples in an apple, peach and pear orchard which she owns on that road. She said that it was done tay revenge, as Marinchak claimed that she and her husband were 1y sponsible for his arrest for violating the liquor law early in September. Mrs. Manelga said she saw Marinchak at 6 o'clock in the morning cutting down the trees and destroying the bark, when she went out to pick to- matoes for her son's lunch box. Marinchak denied that he was in Mus. Manelga's orchard, and produced a number of witnesses who stated that he was talking to them in front of his house at the hour Mr."Manelga suid he was in the orchard. A Polish man testified, howéver, that Mrs. Ma- nelga stopped him on his way to work and told her that Marinchak had cut down her trees.
