INAUGURATION DAY | OFFERS PROBLENS €abinet and Congressmen Puzzled by Unusual Situation Washington, Nov. 10.—The fact that March 4, Inauguration day, falls in 1917 on Sunday is causing more @r less academic discussion. The mat- ter has been considered informally by many officials and by members of the cabinet, senators, and congress- men who stand close to President - Wilson. No one has reached a defin- ite conclusion as to the precise legal solution, 5 | +The outgoing president usually | holds office until noon of the day of | the inauguration of his successor. | Probably a law or state paper signed | by him on March 4 before noon would | be held by the courts or by congress | to be legal and of full force and ef- | foct. Like wise, any similar action by | the new president in the afternoon of urday night, that day would be of full legal force. Secretary Lansing, on whom would fall the responsibility of acting as president ad interim, according to the view of some authorities, has ac- knowledged that he has reached no conclusions regarding the technical- ity anl knows of none reached by others. - He also feels quite sure that no situation will arise nor will any | necessity be likely which will impose on him the brief authority of a chief magistrate. Attorney General Gregory is an- other member of the cabinet whose attention has been drawn to the per- plexing guestion of who would be president in the Sunday interval. His view is that no precedent exists under which to formulate a legal opinion as to the necessity for any intermediate holding of thea office. Little light is afforded by examina- tion of the law provided by congress to meet the contingency of the failure for any cause whatever of a president to perform the duties of his office. This law was drawn by the late Sen- ator Hoar of Massachusetts and went into effect in 1886.
