Bertrand Tower, of Fort Meade, sought by petition of hrbeas corpus to obtain the custody of his infant child, two years old. It appears that the child’s mother died when the child was three weeks old, since which time the grandpar- ents, Mr. and Mrs. Harney, have had the baby. The father of the baby has since remarried, and wanted to take his child with him to his home in Pennsylvania, but the grandpar- ents having become attached to their grandchild, refused to give it up. With the baby in court and all the parties before him and after trying to adjust the accounts between the parties, Judge Whitney ordered that the father be awarded the custody of his child upon the payment of $100 for its care. R. B. Huffaker represented the petitioner. At a recent meeting of the Board of County Commissioners, the road near Medulla was ordered changed from one side of the railroad to the other. The proposed change was ob- jected to by Messrs. . N. and D. M. Pipkin, and so they appeared be- fore Judge Whitney today and sought by bill to enjoin the commissioners from making the proposed change. A temporary injunction was granted. Wilson & Boswell appeared for the complainants and Wilson & Swearin- gen for the defendants. The case of State vs. M. F. John- son has been set for Monday, April 15. Dr. Johnsot, the defendant, stands indicted for the same crime for which W. F. Robertson was found guilty at a special term of the court in January.
