FO THE KEY WEST CITIZEN R FAST ‘QUICK ACTION’ RESULTS — DIAL 2-5661 or 2-5662 Tuesday, August 16, 1954 Top Gang Leader Freed From Pen -- Wants “Peace Of Mind” CHICAGO (P—‘I’m just looking for peace of mind. . .No, I’m not thinking of revenge. . .When you've been in the penitentiary for as long as I have, you forget about revenge.” These were some of the com- ments yesterday of Roger (the Ter- rible), Touhy, one of the nation’s top gang leaders in the Prohibition era, who had just won his freedom from prison. The 55-year old gray - haired Touhy, one-time arch gang foe of the late Al Capone, “had. served more than 20 years in Stateville Prison for a kidnaping which Fed- eral Judge John P. Barnes termed a hoax. Touhy was sentenced in 1934 to 99 years in prison for the kidnaping in 1933 of John (Jake the Barber) Factor, once internationally known confidence man. He received an additional 199 years for his part in his escape from prison with five other convicts in 1942. But Judge Barnes ruled that ‘Touhy had no part in the “alleged” kidnaping, which he said was a hoax engineered by Factor to fore- stall his extradition to England to face prosecution for a confidence game charge. Factor, starting in 1942, served six years of a 10-year federal sen- tence for a million dollar whisky warehouse receipts fraud. Judge Barnes, in granting Touhy a writ of habeas corpus, said the one-time beer baron’s conviction was procured by perjured testi- mony. He said Circuit Judge Thom- as A. Courtney, who was state’s attorney at the time of Touhy’s kidnaping trial, “Must be held re- sponsible for the actions of chief investigator Daniel A. Gilbert in causing perjured testimony to be presented to the jury that con- victed Roger Touhy.” Touhy’s lawyers contended that ‘Al Capone’s old crime syndicate got Factor’ to frame Touhy so Capone could seize various labor ‘unions then dominated by Touhy. The lawyers, in their original writ filed in 1948, charged Touhy’s conviction resulted from a con- spiracy between Factor and law enforcement officials. General Latham Cas- tle ordered an immediate appeal to the United States Court of Appeals. Touhy said he was eager to see | his wife and two sons. He declined to say where his family lived.
