Dr. Hamilton testified that he has been practicing in Key West for eight years. He told how he had been called to attend Mrs. Mansfield, how he put her in his car and took her to his office. He told the court that she had great pain in her thigh, hip, knee and ankle. Dr. Hamilton, reaching in his pocket, said he had notes on the case and asked if he could use them to refresh his memory. Carson objected, saying: “When did you make the notes, doctor?” Dr. Hamilton siad he had made the notes a few days ago. Carson objected, saying it would be all right to use the notes if he had made them at the time of the accident but not. if he had recently made them. However, before Judge Lopez could rule on the objection, Dr. Hamilton told the court that he had forgotten to put the notes in his pocket and therefore didn’t have them with him. Earlier, Claude E.
