ORDINANCE No. 236, COMMISSION: SERIES AN ORDINANCE: PROVIDING FOR THE REGISTRATION AND TAGGING OF ALL DOGS WITH- IN. THE LIMITS OF THE CITY OF KEY. WEST, FLORIDA; AU- THORIZING THE IMPOUNDING AND HUMANE DESTRUCTION OF DOGS; AUTHORIZING THE ACTIVITIES OF THE HUMANE SOCIETY OF KEY WEST; PRO- FRIDAY, JANUARY: 7, 1949.” VIDING A PENALTY FOR vio-| LATING THE PROVISIONS OF | THIS: ORDINANCE; REPEAL-! ING ORDINANCE: NO. 41, COM- MISSION SERIES, OF THE OR- DINANCES OF THE CITY OF KEY ,. WEST, FLORIDA, AND ALL OTHER ORDINANCES IN CONFLICT THEREWITH; AND PROVIDING WHEN _ ORDI- NANCE GOES INTO EFFECT. Be it enacted by the City Com- mission of The City of Key West, Florida: Section 1. DEFINITIONS: Wherever the word “dog” it shall be construed to mean both male and female where the context so requires or admits. Section 2. No dogs, male or. female, shall be owned or’ kept in The City of Key West, Florida, unless properly registered .and tagged as hereinafter ‘ provided. Section 3. No person shall be allowed to keep any dog, male or female, in The City of Key West, Florida, unless. said person’ shall first register such dog with The City of Key West, Florida, and purchase from The City, of Key |. West, Florida, an_ identification tag for each dog for. the.sum of: Two Dollars ($2.00) per’ annum, for a male dog or spayed ‘female, and Three Dollars ($3.00) for a bitch, said tag to.be attached to each dog’s collar and™worn* con- tinuously. The City of Key West; Florida shall upon issye of said tag make a_ record of the ‘name and address of the owner of. said dog, the number of the tag; the physical description of: said dog, and the date said tag was issued. The tags shall be metal and be numbered and issued in regular sequence. ‘ Section 4. Any dog found run- ning at large on any of the pub- lic streets, parks, playgrounds, alleys, or beaches, or vacant, lots in The City of Key West, Florida shall be picked up by the desig- nated authorized agent of the Key West Humane Society and placed in shelter for a period of three (3) days. Said dog may be redeemed by the owner thereof by paying the costs of feeding for ‘the period confined and any other expenses accrued for ser- viees rendered by said Society: Should the dog picked up not be licensed, the owner must comply with the tag requirement before the dog is released. The license fee is double the fee in effect on date the dog is picked up. At the, expitation of three (3) days, if said dog-has not béeri redeemed by the owner, ther '$aid dog shall be humanely destroyed. Section 5. It shall be unlawful for any person, whether owner, or anyone having charge, custody or. control thereof, td keép any dogs within the limits of The City of Key West, Florida which bark or howl at night so as to disturb the sleep and/or peace and quietude of any inhabitants of said City. Section 6. It shall be unlawful for any owner or keeper of any dog to permit said dog to run at Jarge on the public streets, parks or beaches between the hours of ten P. M. of one day, and seven A. M. of the following day. Section 7, In cases of emer- gency, when there is danger of a rabies epidemic, the Mayor may require all owners to have their dogs vaccinated under such regu- lations as he shall see fit. Section 8. No female dog -ia heat shall be allowed to run at large, but shall be kept securely on the owner’s premises until such season is over. Section 9. If a dog is suspected of having rabies, or has been bitten by a dog suspected of having rabies, such dog shall be confined by a chain on the: own- er’s premises and the Humane Society or licensed veterinarian notified at once. Said dog shall then be removed to the proper place for observation for a period of two weeks at the expense of the owner. Section 10. Whoever ‘overloads, overdrives, tortures, torments or deprives of necessary sustenance, food or drink, or unnecessarily or cruelly beats or mutilates or kills any. animals or causes or permits either of such offenses to be committed shall be punished as hereinafter provided. Section 11. Any person viola- ting any provisions of this Or- dinance shall, upon conviction, be punished by fine not exceed- ing Fifty Dollars ($50.00), or by imprisonment in the City Jail, not exceeding ° fifteen days, or both such fine and. imprison- ment, in the discretion of the Municipal Judge. Section 12. PREVIOUS OR- DINANCES REPEALED.
