It is action of that nature that causes disrespect for law. ¢ Key West has an ordinance that provides a penalty of $250 for breaking a parking meter. One man who broke a meter had his fine reduced to $5, and another man, by action of the commission, had the fine reduced to $50. ‘As The Citizen has point- ed out before, the fine is al- together too high with the mandatory clause in connec- tion With it, that is, compell- ing the municipal judge to impose a fine of $250’ and taking away from him all discretionary power. Breaking a meter or vio- lating any other law some- times entails extenuating circumstances. But the judge, in the case of break- jing a meter, is forced by the j ordinance to impose a fine of $250, regardless of any conditions that may pertain to meter breaking. As The | Citizen has suggested, why }not make the maximum fine {$250 and leave it to the | judge to decide whether {there was malicious intent, }as has been shown in some | cases, or merely capricious jimpulse, as has been shown | in other cases, that led to the | breaking of meters. | But if that reasoning does {not appeal to the commis jsion, then let them at leas be consistent. If they are de-| ‘termined to maintain a man- datory fine of $250, then do | not let them emasculate the ‘ordinance by reducing that | fine. Such action causes the public to resent discrimina- tory changes made arbitra- rily by the lawmakers them- selves in the case of any de- |fendant.
