BE IT ENACTED BY THE LEG- ISLATURE OF THE STATE OF FLORIDA; ~~Abolishment Of. Present ‘ Municipality Section 1.°‘That” the present! Municipal Cérpotation and its! Government exisfing under the name of the “City of Key West” be and the same is hereby abol- ished. Ordinances To Remain In Effect Section 2. All existing Ordi- mances and Resolutions of the present Municipality of said City of Key West regularly passed, promulgated and enrolled on the date of the passage of this Act shall remain in effect and unim- paired until repealed, amended, or } modified by the new Municipality | which is hereby ofganized and| created, provided such Ordinances and Resolutions be not inconsist- ent with the provisions of this Act. Officers Held Until Successors Qualify Section 3. “That all_officers heretofore elected or appointed and holding office‘ under the ‘said’ Municipality shall continue to hold their respective offices and to dis- charge the: duties thereof and re- re the emoluments thereof un- til their successdrs are elected andlor appointed andor qualified. Title To Property Reserved To New Municipality Section 4. That the rights, title and ownership of property, uncol- lected taxes, dues, claims, judg- ments, decrees and choses in ac- tion, held or owned by the City of Key West shall pass to and shall be vested in the Municipal Cor- Poration organized under this Act to succeed the Municipality abol- ished.” Contracts Remain Binding Section 5. That all valid and enforcible indebtedness, obliga- tions, and contracts of said City of | Key West, including all bonds is- | sued and outstanding, shall remain valid and enforcible notwithstand- ing the passage of this Act andj} such indebtedness, obligations and contracts shall be imposed upon and shail be binding upon the new. Municipality which is hereby organized and created. No suit or right of said City shall abate by reason of said dissolution. Establishment Of New Municipality tion 6. The inhabitants of | the'Island of Key West, in Mon-| roe County, Florida, shall be and are. hereby constituted a body politic and corporate to be known and designated as the “City of Key West” and as such shall have perpetual succession. Said City shall have and use a common seal and may change the same at pleas- ure; the City may sue and be sued, may plead and be implead- ed in all Courts and places, in all; matters and proceedings, and may contract and be contracted with in regard to all matters and things. Boundaries Section 7. The territorial boundaries of said City of Key West shall include the entire Island | of Key West, Monroe County, } Florida, including all territories! | composed vested in a Mayor and a Com- mon Council consisting of seven members to be called the City Council of the City of Key West, and the Mayor and said seven Council shall be elected by the qualified electors of said City from said City at Large. The Council shall elect one of _ its members President of the Coun- cil. Compensation Of Councilmen Section 10: “The -compensation of said Councilmen of the City of Key West shall be Seventy- five Dollars ($75.00) per month. City Divided Into Wards Section 11. That said City shall be divided into six wards, to be known ahd designated as the First, Second, Third, Fourth, Fifth and Sixth Wards, respectively, which wards shall be as follows: The First Ward shall be all that portion of the City of Key West, according to Chas. W. Tift’s map, within the following territory, viz: Squares One, Two, Three, Five, Six, Seven, Eight, Nine, Ten, Eleven, Twelve, Thirteen, Fourteen, Fifteen, Eighteen, Nine- teen, Twenty, Twenty-one, Twen-/ ty-two, Twenty-three, Twenty- four and Twenty-five, { The Second Ward shall be all that portion of the City of Key West, according to Chas. W Tift’s map, within the following terri- tory, viz: Squares Thirty-one, Thirty-two, Thirty-three, Thirty- four, Thirty-five, Thirty-six, Thir-} ty-seven, Thirty-eight, Thirty- nine, Forty, Forty-four, Forty- five, Forty-six, Forty-seven, Forty- eight, Forty-nine, Fifty and Fif- ty-one. The Third Ward shall be all that portion of the City of Key West, according to Chas. W. Ti map, within the following ter tory, viz: Squares Fifty-two, Fif. ty-five, Fifty-six, Fifty - seven, Fifty-eight, Fifty-nine, Sixty, Six- ty-one, Sixty-two, Sixty - three and Sixty-four. The Fourth Ward shall be all that portion of the City of Key) West according to Chas. W. Tift’s/ map, within the following terri- tory, viz: Tracts Three, Four, j Five, Six and Seven. be The Fth Ward shall be all that portion of the City of Key West, according to Cnas. W. Tift’s map, within. the following territory, viz: ‘Tracts Ten, Eleven, Twelve ‘and Thirteen. The Sixth Ward shall be all that portion! of the City ‘of Key West, ‘according to Chas, W. Tift’s map, within the following territory, viz: Tracts Fourteen, Fifteen, Six- teen, Twenty, and all other por- tions of the city not included in the other described wards. Provided that the City Council shall have the right and power to change alter or abolish or increase ‘the boundaries of the wards in or- der to equalize them as far as pos- sible as to size and population. Officers Section 12. The government of said city shall be carried on by the following officers:, A Mayor, the City Council, a Chief of Po- lice, a Captain of Night Police, a Police an assistant to the Chief of Po- lice, a Clerk, a Treasurer, a Mu- nicipal Judge, to be known as the Police Justice, a Tax Assessor- Collector, an Auditor, a City At- torney, Chief of Fire Department, a Health Officer, a Sexton, a Board of Election Commissioners, of three members, a Board of Public Works, composed | of five members, and such other officers as may be provided by Ordinance not, inconsistent, here- | with; and all of said officers shall | | be qualified electors of said City | of Key West, and shall perform such duties and receive such com- pensation as may be prescribed by ordinances of the City of Key West not inconsistent with the pro- visions of this Act. Officers Not To Be Interested In Contracts Section 13. No member of the City Council, nor any appointee thereof, or any other officer of the City Government shall directly or indirectly enter in any contract work, or work of any kind a said City. If two-thirds of said City Council present shall sus- tain the charges preferred by the Mayor, the officer shall stand dis- missed. The Mayor shall have the right to appoint some suitable person to perform the duties of said sus- pended officer until the Council shall have passed on such suspen- sion. If said suspension is sustained by the Council, the Mayor shall at} once. appoint a successor to said officer who shall be confirmed by the Council. = The Mayor shall be élected by the qualified electors of the city and shall be a qualified elector of such city. Municipal Judge Section 15. There shall be elect- ed by the qualified electors a Mu- nicipal Judge, to be called the Po- lice Justice, of the City of Key West. ‘ It shall be the duty of said Po- lice Justice to hold daily terms | of court, in such place as may be | provided by ordinance, for the trial of all persons charged with the violation of any of the ordi- nances of said city, which trial shall be without jury,.and upon conviction of such person or per-| sens, to impose-upon him or them! such_penalty as may be provided | by ordinance. i |, He shall have power to summon | witnesses, issue warrants of ar-| rest upon affidavit duly filed, to} administer oaths, and to do all oth- er acts necessary for the perform- ance of his duty. He shall also | have the power to punish for con- tempt of court, committed during the trial of any cause, in the pres- ence of the court; to issue attach- ments for those who have been summoned as witnesses and have failed. to appear and fine or -cora- mit said persons for their default. The Police Justice shall have the power in addition to the im- position of fines and sentences to impose reasonable costs to be pre- scribed by ordinance upon any person, firm, or corporation con- | victed before said Police Justice. He shall not have power to pass upon the validity of any ordinance of said city. In case of the absence, sickness or disqualification of the Munici- pal Judge, the Mayor shall hold daily terms of Court, or the Mayor may appoint some suitable person to act as such Police Jus- tice who shall have all the pow- ers and perform all the duties of such Police. Justice during the sickness, absence or disability of the Polige Justice. City Clerk Section 16. The City Clerk shall be elected ‘by the qualified felectors of the City of ‘Key West. + He:shall also be Clerk’ofithe Mu- ‘nicipal Court. The Clerk’ shall perform such duties ;.as may be | prescribed by ordinance not in- {consistent with this Act. Tax Assessor-Collector Section 17. There shall be elected by the qualified electors of said City a Tax Assessor-Col- lector of said City whose duties shall be such as are hereinafter set forth and which are already prescribed by ordinance not in- consistent with this Act. He shall be liable for any loss to the City by reason of his failure to perform any duty required of him hereun- der. He'shall be both the Asses- sor and Collector of Taxes. City Treasurer Section 18. He shall perform such duties as are now and may be hereafter prescribed by ordinance. City Attorney Section 25. The City Council shall elect a City Attorney who shall perform all the duties im- posed upen him by the provisions of this Act and such other duties as may be prescribed by otdinance, | and save as herein prescribed, his compensation shall be fixed by ordinance. Supervisor Of Registration Section 26. It shall be the duty of the City Council to elect some suitable person who ‘shall be in like manner a’ if approved by the Mayor or Acting Mayor. No. ordinance shall become a law with- out having been read once upon two separate days. The Président of the City Coun- cil shall receive the same amount of compensation for his services as is designated as salary for the Mayor for the time he so serves, said City of Key West in any court of competent jurisdiction. (f) To regulate or prevent the establishment or maintenance of ; any noisome or offensive business or condition within said city detri- mental to the health or welfare of the inhabitants thereof. (g) To regulate, license or pro- hibit the keeping of canines, felines or other animals and poul- try or other fowl within said city and to prevent the same from run- ning at large in the streets of the city or within the cit¥ limits and to provide .for the destruction thereof; to regulate the location and manner or keeping barns, stables.or any other place, which |for and the class of buildings to be erected therein. It shall be the duty of the Mayor to appoint such sani- tary officers or assistant sanitary officers as may be necessary who} shall perform such duties as may| be required by ordinance. City Auditor Section 29. The City Council shall elect some suitable person to be known as the City Auditor | who shall perform all the duties required by ordinance now in force or which may be hereinafter | prescribed. Oath Section 30. All officers of said city shall, before entering upon the discharge of their duties, take and subscribe an oath, before some person authorized to admin- ister oaths, that they are entitled to hold office to which they have been elected or appointed, and file the same with the City Clerk} and shall also give bond in such sum as may be required by ordinance, [residence, or physical disability or .removal, failure to qualify, non- in case of failure to elect a Mayor, the’ President of the City Council shall discharge the duties of the officd bf ‘Mayor, until a successor for the unexpired terms shall be elected by the City Council, which election shall be held within thir- ty ‘days after the happening of a vacancy. If approved, the} Mayor or Acting Mayor shall sign the same and return it to the City Council at the next regular meet- ie. If disapproved, he shall return the same, with his objections in writing, to the City Council at its next regular meeting, who shalt; cause thé same to be entered in| ceedings, with the Mayor’s objec- tions thereto, and a} said meeting shall proceed to consider said ob- jections and pass upon the same. (o) To. establish quarantine and health regulations for the City of Key West not inconsistent with the rules and regulations of the State Board of Health.
