It looks as though the senate would have to revamp the Rines Warner bill providing for 5 per cent gross earnings tax and extending tax to miscellenecus cources of income. Under the Oklahoma case against the Wells-Fargo company, it ‘s urged |the United States Supreme Court |has held that a state cannot tax in- come of a common carrier earned outside of that state. Under the |@mendment as it passed the House, jtbe railroads which are Minnesota | corp orations would have to pay a tax on miscellamecus sources of in- ‘come derived from property situated | Qutside of Minnesota. The other point involved is one of policy. It. hes reference to the ap- parent woodchuck discovery by At- jtorney Genera] Smith Wednesday which probaplf) will be corrected by the Cheadle amendment. The amend jWoent, if it goes through, might ex- empt 2]] of the Great Northern rail- |way ore property on the range from jthe present ad valorem tax pai@ im \ St. Louis county. Tax on the income jof this property which is active un- der the amendment is considerably Jess than is paid now into the county | treasury in that county, where the property exists. There is also this point to pe con- |sidered: Dormant property which is jtaxed now would not be taxed under | the amendment. It must be active jim order to yield @ tax under the Rines-Warner bill. There wap a movement on foot to Split the gross earnings tax bill into jtwo separate amendments, one speci- fically taxing income earned from actua] operation at 5 per cent and the other taxing on 4 gross earnings basis miscellaneous sources of in- come derived from property in the etate, with the exception of rea] es- tate now taxed locally on a straight ; Valuation besis. Some mempbers.took the position that this would insure the safety of the 5 per cent tax on earnings from actual operation. Then if the other amendment was passed and knocked out by the Supreme (Court, the entire amendment would not be invalidated.
