He finds them greatly interested in the Minnesota cases and especially in that feature of the Sanborn opinion relating to the valuation of railroads, in which the court held that the cost of reproduction was the proper basis for the valuation of such property. The commission has held that in valuing such property the original cost shall be taken into consideration. Clayton Sherburne, the little nine year old son of Mr. and Mrs. G. W. Sherburne, was drowned Tuesday af- ternoon in the creek on the south side which empties into the Mississ- ippi river. It seems the little fellow, his older brother, Roy, his sister, Mildred, Car- rol and Lowell Carpenter and Ted Smith were paddling round on a raft made from logs and were about to leave the water. Clayton stood on the edge with his back to the water when his older brother threw in a stick. This startled him and he turned quickly, lost his balance and fell in backwards. The impetus shoved the raft away and before as- sistance could be given the little fel- low sank from view. He did not come up.again and the children) immediately gave the alarm. A party of men gathered and endeavored to locate the body, but it remained in the watey an hour and a half before this was done, when it was found by the father.
