} “OFFICIAL PROCEEDINGS OF THE BOARD OF COUNTY COMMISSIONERS ITASCA COUNTY, MINN Grand Rapids, Minn., May 4, 1911. Pursuant to adjournment the Board of ~ County Commissioners of Itasca Coun- ty, Minnesota, met at the County Court house in the Village of Grand Rapids, this 4th day of May, 1911, at 10 o’clock a. m. Members present: Commissioners Mul- lins, Shellman and Nelson. The matter of the petition for the es. tablishment of County Road No. 94 was then taken under consideration. The committee appointed to examine the route of said road filed their report in which they recommended that the pray- er of the petitioners be granted. Commissioner Shellman moved that the report of the committee be approved, that said highway be hereby ordered tablished according to the committee’s report and that the advantage and ben- efits to each description of land over which said road runs be hereby assessed equal to the damages sustained. The motion was seconded by Commis- sioner Nelson and carried by unanimous votey The bids for the construction of ad- ditions to the County Court House were opened and read. The bids being as follows: Chas. E. Hagstrom & Co. for $7,198.00. L. F. Ursin for $7,343.00. Emil M. Johnson for $8,335.00. Graham Young Co. for $10,496.00. Bids were received for bridge across Swan River at Willman’s place on the Feeley-Bovey road as follows: Hennepin Bridge Co., $2,260.00 for steel bridge. Hewitt Bridge Co., $2,288.00 for steel bridge. Cc. W. Kent & Fred Christianson, $1,- 375.00 for wooden bridge. J. S. Lofberg, $1,748.31 for steel bridge J. S. Lofberg, $1,422.75 for wooden bridge. The Twin City Bridge Co., $2,375.00 for steel bridge. The Security Bridge Co., $2,337.00 for steel bridge. Penn Bridge Co., $2,295.00 for steel bridge. A. Y. Bayne & Co., $2,349.00, steel bridge. : H. J. Cooper, $1,550.00, for steel bridge Bids were receivebd for bridge across Bigfork river in section 7, township 148, range 26, as follows: Malcolm Campbell & John E, Westman, $5,785.00. W. J. Hallet, $1,800.00. All of the foregoing bids were tempor- arily laid over for further consideration. A petition was presented for the in- corporation of certain territory as the Village of Zempel. Said petition was read by the Auditor and temporarily laid over for further consideration. Commissioner Shellman moved the adoption of the following resolution: Resolved, that the Wisconsin Steel Company be and is hereby granted per- mission to lay a line of railroad across County Road No. 63, at a point on said road about 100 feet west of the section line between sections 5 and 6 in Town- ship 56, Range 22. ‘The motion to adopt the resolution was seconded by Commissioner Nelson and said resolution was adopted by unani- mous vote. Commissioner Shellman moved the adoption of the following resolution: Resolved, that relief in the sum of $15.00 per month be allowed to Mike Munter of the Town of Carpenter. Said relief to take effect for the month of May, 1911, and to continue for each month thereafter until further action is taken thereon by said Board and that the County Auditor be instructed to issue his warrant monthly in payment of such relief. The motion to adopt the resolution was seconded by Commissioner Nelson and carried by unanimous vote. An adjournment was taken to o'clock p. m. Pursuant to adjournment the Board again met at one o'clock p. m. All members of the board present. Commissioner Shellman moved the adoption of the following resolution: Resolved, that the sum of $500.00 be and the same is hereby appropriated from the County Road and Bridge Fund to the Town of Wawina, to aid said ‘Town in the repair and construction of roads and bridges. Resolved further, that the sum of $300 be and the same is hereby appropriated from the County Road and Bridge Fund to the Town of Bearville to aid said Town in the construction of County Road running north and south through the center of Township 61, Range 22. Resolved, further, that the sum of $500 be and the same is hereby appropriated from the County Road and Bridge Fund to the Town of Carpenter, to aid said Town in the construction of County Road running north and south in the center of said Town. Resolved further, that the sum of $500 be’and the same is hereby appro- priated from the County Road and Bridge Fund to the Town of Balsam, to aid said Town in the construction of a road running from Prairie River Road near the center of Section 30, Township 58, Range 24, east and connecting with the Nashwauk and Bovey Road. Resolved further that the sum of $300 be and the same is hereby appropriated from the County Road and Bridge Fund to the Town of Spang, to aid said Town in the repair and construction of roads and bridges. The motion was seconded by Commis- sioner Nelson and carried by unanimous vote. The county surveyor was instructed to survey a piece of road on line be- tween Townships 53-23 and Town 54-23, near the point where said line crosses the Swan River. Commissioner one Shellman moved that the sum of$500 e County Road and Fund to. be expended under his direction in the im- provement of County road No. 63. ‘The motion was seconded by Commis- sioner O’Brien and carried by unanimous vote. The application of C. D. Lyons for licenses to sell intoxicating liquors at Ball Club was withdrawn upon the re- quest of the applicant. It being the time set for hearing up- on the application of J. J. McDonald for a license to sell intoxicating liquors at Swan River in the Town of Wawina, the same was then taken under con- sideration. There being no objections filed or offered against the granting of said application, Commissioner Nelson moved that said application be allowed and license issued to said J. J. McDon- ald, subject to his furnishing a surety bond approved by the County Attorney and the Chairman of the County Board. The motion was seconded by Commis. sioner O’Brien and upon roll call was carried. The vote being as follows: Yea: Commissioners Mullins, O’Brien, King, Shellman and Nelson. Nay: None. The matter of the application of Frank Payne for license to sell intoxicating liquors at Ball Club was then taken un- der, consideration. A petition signed by a number of the settlers residing in the vicinity of Ball Club urging the Board to grant one li- cense at Ball Club, also a petition against the granting of any license at Ball Club, were read. After consider- able discussion of the matter, Commis- sioner Shellman moved that the hearing upon said application be continued to the next meeting to be held June 8th, 1911, at 2 o'clock p.m. The motion was seconded by Commissioner, O’Brien. Commissioner King then moved as a substitute motion that the application be granted which motion was seconded by Commissioner Nelson and upon roll call the vote was as follows: Yea: Commissioners King and Nelson. Nay: Commissioners Mullins, O’Brien and Shellman. The original motion was then carried by the following vote: Yea: Commissioners Mullins, and Shellman. Nay: Commissioner King, Commission- er Nelson not voting. The Chairman thereupon declared the hearing continud to the next meeting to be held on the 8th day of June, 1911. It being the time set for hearing upon the aplication of Gust Johnson for li- cense to sell intoxicating liquors at Snow Ball, the same was then taken un- der consideration. Commissioner| King moved that said application be rejected. The motion was seconded by, Commis- sioner Nelson and carried by unanimous vote. It being the time set for hearing up- on the application ef Emil Erickson to sell intoxicating liquors in the Town of Marcell the same was then taken under consideration. A number of persons were present and made objection to the granting of said application, Mr. John Lundeen urged the Board to grant said application. After hearing all parties in favor of and against the granting of said application, Commissioner Shellman moved that said application be rejected, which motion was seconded by Commis- sioner O’Brien and upon roll call was carried by the following vote: Yea: Commissioner Mullins, Shellman and Nelson. Nay: Commissioner King, who stated in recording his vote against the motion, that he did so upon the ground that said application was granted at a meeting of the Board held on the 4th day of April, 1911, but owing to a defect in the notice of hearing a new notice was given for hearing at this meeting. The matter of the bids for the ocn- struction of a bridge across Bigfork Riv- er was again taken up and upon motion of Commissioner King, seconded by Com missioner Shellman, all bids were reject- ed by unanimous vote. Commissioner King then moved that the County Auditor advertise for bids for the construction of a bridge at said point, all bidders to furnish their own specifications. The motion was seconded by Commis- sioner Nelson and carried by unanimous vote. The bids for the construction of a bridge across the Swan River at Will- man’s Place on Feeley-Bovey Road were then considered. The bid of H. J. Cooper to construct a steel bridge at said point for the sum of $1,550.00 being the lowest and best bid, Commissioner Nelson moved that said bid be accepted. The motion was seconded by Commis. sioner Shellman and carried by unani- mous vote. The bids for the construction of addi- tions to the County Court house were again taken under consideration. The bid of Chas. E. Hagstrom & Company being the lowest and best bid, Commis- sioner O’Brien moved that said bid be accepted, the motion was seconded by Commissioner Shellman and carried by unanimous vote. Commissiorier Nelson offered the fol- lowing resolution and moved its adop- tion: “Be it resolved that there is here- by allowed and ordered to be allowed one Deputy Register of Deeds in this County, pursuant to the provisions of Chapter 382 of the General Laws of Minnesota for 1911, the sum of Five Hundred Dollars ($500) per year, as com pensation for his or her services as such deputy, same to be paid by the county and out of the county treasury thereof in the same manner as {s authorized by law for payment of salaries of county officers, and this order to remain in force until revoked by the county board of this county. This order to apply in favor of such deputy, heretofore or here- after duly appointed as may be designat ed by the Register of Deeds, by writing filed with the county auditor with this order, such designation to be subject to change from time to time by said Regis- ter of Deeds. Be it further resolved that this order be filed in the office of said county auditor and shall thereupon take effect at once. Said motion was duly seconded by Con missioner O’Brien, and put to a vote. Commissioners Mullins, O"! ing, Shellman and Nelson voted in favor thereof and none against the same, and said motion was therefore duly carried and said resolution adopted and so de- clared. O’Brien O’Brien, NEIL MULLINS, Chairman of County Board of Itasca County, Minn, Pokegama Lake Ferry. The application of W. A. Kiley for a position as ferry- man was read. Commissioner Nelson moved that W. A. Kiley be appointed to operate said ferry and that his compen- sation be fixed at $50.00 per month, he to make necessary repairs upon the ferry engine without additional compen- sation. The motion was seconded by Com- missioner O’Brien and carried by unani- mous vote. The County Surveyor was instructed to survey County Road No. 42, beginning at the quarter post. of sections 24 and 25, Township 54, Range 25, and running thence west and south to the South- west corner of said Township, there con- necting with the Hill City Road, and also to prepare specifications and esti- mates for the construction of the same. Commissioner King moved that a re- ward of $500.00 be offered by the Coun- ty of Itasca for information that will lead to the arrest and conviction of the person whi set the fire which destroyed the building of R. C. Payne’s at Ball Club on the night of April 26th, in which fire Ralph Lane lost his life. The motion was seconded by Commis- stoner Nelson and carried by unanimous vote. Upon motion of Commissioner O’Brien, seconded by Commissioner King, the County Surveyor was instructed to sur- vey a road in Sections 7 and 18, Town- ship 57, Range 26. A petition was presented for the estab.) lishment of a highway beginning at the Southwest corner of Lot 4, Section 6, Township 55, Range 24, and running thence in a southeasterly direction to the point 1,200 feet west of the corner post of sectioms 6 and 7 in said township, thence in asoutheasterly direction to the quarter post of said section 7, thence south along the range line to the point of intersection with the Grand Rapids road, said point being at the southwest corner of section 18, Township 55, Range 24. Commissioner Nelson moved that a hearing be had upon said petition at the court house in Grand Rapids on Thurs- day the 8th day of June, 1911, at 10 o'clock a. m., that Commissioners Mor- ris, O’Brien, Jno. L. Shellman and Andy Nelson, members of this Board be @ committee to examine the route of said proposed road, that said committee meet at the point of beginning of said route on Friday the 2nd day of June, 1911, at two o'clock p. m. for the purpose of ex- amining said route, and that said com- mittee make report to this Board at the time set for hearing upon said petition, The motion was seconded ‘by Commis- sioner Shellman and carried by unani- mous vote. The County Surveyor was instructed to survey. that part of said route above described where the same does not run uport the range line, and to file his re- port thereof with the County Auditor. The following petition was presented: To The Board of County Commission- ers of Itasca County: Honorable Sirs: We, the undersigned, Supervisors of the Town of Blackberry, County of Itas- ca and State of »innesota, respectfully represent that the said town of Black- berry have resolved to construct a bridge of steel, stone and concrete @a- cross the Mississippi River, on the le- gally established highway near the cen- ter of Section 8 in said Township, which said location is not within the corporate limits of any city of the first, second or third class. We further represent that the town- ship of Blackberry has provided for the payment of one-half of the costs of the construction of said bridge, the total es- timate cost of which will be $10,000.00, which amount far exceeds one-eighth of one per centum of all of the jtaxable property in said township accoriling to its last equalized valuation. In consideration of the facts as above set forth and pursuant to the provisions of Chapter 423, Laws of 1907, we re- spectfully ask that the Board ef Coun- ty. Commissioners of said County of Itasca shall appropriate the other one- half of the cost of the construction of said bridge, and that said County Board shall forthwith, as provided by said Chapter 423, Laws of 1907, designate two of its members as a committee to co-operate with the supervisors of said Township of Blackberry in the letting of a contract for the construction of said bridge. Commissioner King moved that. the chairman appoint two of the members of the Board as a committee to co-op- erate with the Board of Supervisors of said Town of Blackberry in the letting, inspecting and acceptance of the work of the construction of said bridge. The motion was seconded by Commissioner O’Brien and carried by unanimous vote. Commissioners O’Brien and Mullins were appointed as such committee. Commissioner King moved that the whole board be appointed to confer with the Commissioners of Cass County, Te- garding the matter of the construction of a bridge across the Mississippi Riv- er between the counties of Cass and Itasca. The motion was seconded by Commis- sioner Shellman and carried by unani- mous vote. Commissioner King moved that the chairman appoint a committee of three to examine roads in the Towns of Bear- ville and Carpenter and to report at next meeting. An adjournment was then taken to 7 o’clock p. m. Pursuant to adjournment the Board met at 7 o’clock p. m. Members present: Commissioners’ King, Shellman, Nelson and O’Brien. In the absence of Chairman Mullins, Vice Chairman Shellman presided. A petition was presented for the es- tablishment of a highway beginning at the northeast corner of the southeast quarter of section 18, Township 148, Range 28, and running west on quarter line through sections 13 and 14, thence north on section line between sections 14 and 15, 10 and 11, thence iho on section line between sections bare 4 and 9, 5 and 8, 6 and 7, To this he thence north on section line between sections 3 and 4, to Town line thence west on Town line to the County line. Commissioner King moved that a hearing be had upon said petition at the court house in the Village of Grand Rapids on Monday the 10th day of July, 1911, at 10 o’clock a. m., that Commis. sioners Andy Neilson, Morris O’Brien and C. M. King be a committee to exam- ine the route of said proposed route, that said committee meet at the point of beginning of said route on Thursday the 6th day of July, 1911, at 11 o’clock a. m. for the purpose of examining said route and that said committee make re- port to this Board at the time set for hearing upon said petition. The motion was seconded by Commissioner O’Brien and carried by unanimous vote. The matter of the incorporation of the Village of. Zempel was again taken up. A hearing having been granted to all persons interested in the matter of said corporation and the Board having heard all arguments in favor of and against said petition, Commissioner O’Brien mov ed the adoption of the following resolu- tion: “Whereas, Ed. Staten and thirty-four other persons, legal voters within the territory hereinafter described, have made and filed with the county auditor, as clerk of this board, a petition signed by them, which petition has been pre- sented to this board, setting forth, among other things, that said petitioners are legal voters residing within the fol- lowing described territory, to wit: Lots one (1), two (2), three (3), four (4), five (5), six (6), seven (7) and eight (8) and the southeast quarter of the north- east quarter (SE% of NE) of section one (1), lots one (1) and eleven (11) of section two, in township one hundred forty-four (144) north, of range twenty- five (25), west of 5th P. M., in Itasca County, Minnesota, including all of Lakeview Addition of Itasca City, in said Itasca county, according to the plat thereof on file and of record in the office of the registr of deeds of said county; that said petitioners have caused to be taken by three of them on the 28th @ay of April, 1911, an accurate census of the persons residing on the territory before described, a statement of which census is attached to said pe- tition and made ‘a part thereof; that a description and the boundaries of said territory proposed to be incorporated as a village are as above set forth and the quantity f land embraced therein’ is 430.61 acres; that said lands include 19.95 acres of platted lands duly platted as “Lakeview Addition to Itasca City”, which is divided into lots and blocks and is more particularly described in the pe- nition, and that the plat thereof has been duly and legally certuced accord- ing to the laws of this state and filed in the office of the register of deeds of this couny; that the unplatted lands of said territory adjoin the platted portions thereof and is so constituted as proper- ly to be subject to village government; that the actual number of residents on all of said territory is 215, and that the number thereof does not exceed 3,000 and is not less than 200; that none of said territory is already incorporated, nor is any part hereof within the limits of any incorporated city, village or bor- rough; that it is proposed and desired to incorporate all of the territory above described as a village and that the name of said proposed village is ‘‘Zem- pel’, and praying that this board pro- ceed according to law to call an elec. tion for the determination of such pro- posed incorporation and take all steps and proceedings required by law for such purpose, which petition was duly verified by three of said petitioners, de- claring such census was accurately tak- en on the day specified and that the statement contained in the petition is true. “And, whereas, this board, after duly considering said matter, is of the opin- ion and does hereby determine that the contents of said petition are true and that it is expedient and for the best interests of the residents of said terri- tory that said petition be granted and that an election should be called and held for the determination of such pro- posed incorporation and that all further steps and proceedings be taken as re- quired by law for such purposes; “Now, therefore, be it resolved that sald petition and the whole thereof be granted, and it is hereby approved; that the 25th day of May, 1911, between the hour of 10 o’clock a. m., at which time the polls shall open, and 4 o'clock p. m., at which time the same shall close, and the frame building known as the Deer River Lumber Company office, situated on Lot 4, in section 1, in town- ship 144, range 25, in said county, with- in the boundaries of said territory pro. posed to be incorporated, be, and the same hereby are fixed as the time and place for holding an election of the le- gal voters residing witnin said territory for the purpose of determining whether said territory shall be so incorpormted as the Village of Zempel; that an election be so held at said time and place as before specified, and that the county auditor is hereby authorized and di- rected to issue and cause to be post- ed in three of the most public places within said territory, there being no newspaper published within the same, not less than twenty nor more than thirty days prior to the day so fixed for said election, a notice of the same, specifying and fixing the time and place thereof as aforesaid, and containing all the details required by law, including a specification of the purpose of said election, and a description of the terri- tory proposed to be incorporated, togeth- er with a copy of said petition, attach- eq to said notice. “Be i€ further resolved that EX. Stat- en, D. S. Zetterstrom and William Mart- indale, legal voters and residents of the territory proposed to be incorporated, be and they hereby are appointed in- dpectors, to act as judges of said elec. tion, conduct the same according to law, make due return of their proceedings, and to perform all other duties by law required of them.” Dated this 4th day ef May 1911. Upon motion of Commissioner King, seconded by Commissioner Nelson, the County Surveyor was instructed to make a survey of the Road known as the Johnson Road in the Town of Popple. The matter of the petition for survey of section 36, Township 56, Range 26, was then taken up. County Surveyor of Itasca County, be instructed to make such survey, said survey to begin on the Sth day of June, 1911. The motion was seconded by Commis- sioner Nelson and carried by unanimous vote. A meeting of the Board of County Commissioners of Itasc& County, Minne- sota, was held at the Court House in the Village of Grand Rapids this 5th day of May 1911, at 9 o'clock a. m. Members present: Commissioners Mul- lins, King and Nelson. Commissioner King moved that a com- mittee of two be appointed to examine road between sections 15 and 16, Town- ship 56, Range 27, said road being known as County Road No. 92. That said committee have authority to sell the job of the construction of said piece of road. The motion was seconded by Commissioner Nelson and carried by un- animous vote. Commissioner King and O’Brien. were then appointed as such committee. The county auditor was instructed to write to W. M. Henderson, Forest Ranger, Bena, Minnesota, in regard to the proposition of putting a telephone te Township 148, Range 27. The County Auditor was instructed to adyertise for bids for the construction of one mile of road beginning at the quarter post on the east side of section 1, Township 150, Range 29, and running in a southeasterly direction to the south one-eighth line of section 6, Township 150, Range 28, thence east on said eighth line to the County Road. The County Surveyor was instructed to make an estimate of the cost of eutting down hill on road on town line between the townships of Grand Rapids and Arbo. Commissioner O’Brien arrived at this time.
