Commissioner King moved that the sum of $300.00 be appropriated from the County Road and Bridge Fund to the Town of Moose Park to aid said town in-the repair and construction of roads and bridges. Re it further resolved that the sum of $45,000.00 be and the same is hereby made a levy upon all the taxable prop- erty in the County of Itasca, for the vear 1908 as -provided for by section 1205 Revised Laws of 1905, as amended by Chapter 423, Laws of 1907, to pro- vide a fund for the repair and con- struction of roads and bridges in said further resolved that the sum of $12,000.00 be and the same is hereby made a levy upon all the taxable prop- erty in the County of Itasca for the veay 1908 for the support of poor of said county. Board of County Commis- sioners of Itasca County Minn: We hereby respectfully make appli- cation to your honorable body and ask that the option for mining lease made by the Roard of County Commissioners for said County in writing, to John Rellis and Earnest N. Remer, of the Village of Grand Rapids, Minnesota, dated the 29th day of August, 1907, pro- viding for the exploration of lots 6 and 7 and the NW% of the NE\% and the NW¥Y. of the SE% of Section 18 in Township 55 norty of range 25 west of the Fourth P. M.. in Itasca County, Minn.. for the iroh ore and other min- eral, and the giving of a mining lease of the iron ore and mineral on, within and under said lands, providing for the mining and removal of the same according to the terms and conditions of said option contract, be extended and continued for a period of one full vear from the date of the termination thereof to-wit. one year from and af- ter August 29. 1908, and we state as reacons therefor, as follows: That immediately after the giving of caid option contract, the parties of the second part thereto, called the erentees therein, to-wit, John Rellis and Earnest N. Commissioner O’Brien offered the following resolution and moved its adoption: _ Whereas, on the 29th day of August 1907, this Board of County Commis sioners duly entered into an option contract for mining lease with John Rellis and Earnest N. Remer of the Village of Grand Rapids, Itasca Coun- ty, Minnesota, giving to John Rellis and Earnest N, Remer, the exclusive option for mining lease for the ex- ploration of the lots 6 and 7 and the NW of the NE% and the NW% of the SE% of Section 18 in Township 55 north of Range 25 west of the Fourth P. M., in Itasca County, Minn., known as the “Poor Farm”, and the giving of a mining lease to said Rellis and Remer, their heirs, representatives and assigns, to mine and remove iron ore and other mineral found on, with- in or under said lanas, the said option being for one year from and after August 29, 1907, and Whereas, the said parties of the sec- ond part to said option contract there- after duly commenced the exploration of said lands for iron ore and other mineral, according to the terms and conditions of said option, and_ have duly prosecuted, carried on and con- tinued said work of exploration and drilling of the said lands for iron ore, and other mineral, according to the terms and conditions of said option contract, and have in all respects com- plied with and performed the terms and conditions of said option contract upon their part to be performed, in- cluding the furnishing of reports and blue prints and other data to this Board, showing the work performed under said option contract, and Whereas, the said exploration of said lands has not been completed and will not be completed within the life of said option, to-wit. on or before August 29, 1908, and at the date here- of, there has not been found upon, within or under said lands sufficient iron ore or other mineral for the tak- ing of the lease provided for by said option, and Whereas, the said exploration has not been completed, but there Is a large part of said lands still unex- plored, on, within or under which iron ore and other mineral may exist in quantities and amounts sufficient to warrant-the taking of a lease and the mining and removal of the same, and Whereas, said John Rellis has died since the giving of said option _con- tract and one Margaret Ann Rellis Wright has been appointed his admin- istratrix and representative by the Probate Court of said County, and is lawfully entitled te represent the estate of said deceased, and 5 Whereas, said Margaret Ann Rellis Wright as representative of the estate of said John Rellis, deceased, and said Earnest N, Remer have duly applied for an extension of said option con- tract for a period of one year from and after August 29, 1908, for the purpose of continuing the said exploration, and prosecuting the same until said lands are fully explored for iron ore and other mineral according to the terms of said option contract, setting forth as reasons for the same, all of the facts hereinbefore stated, and Whereas, it appears to this Board that it is to the best interest of said county that the said exploration shall be continued until said lands are fully explored according to the terms and conditions of said option contract and that it is to the best interest of said county that the said option contract be continued and extended for a period of one year from and after August 29, 1908, so as to permit the said par- ties of the second part thereto and their representatives and assigns, to continue the said exploration of said lands for iron ore and other mineral unti] said lands are fully explored or until a mining lease shall be taken as therein provided or the said con- tract be terminated according to the conditions thereof, Now, therefore, be it resolved, that the said proposition and application for the extension and continuing of said option for mining lease for a period of one year from and after August 29, 1908, be heard and_consid- ered by this Board of County Commis- sioners on the 26th day of August, 1908, at 10 o’clock A. M., of said day at the office of the County Auditor in the courthouse in the Village of Grand Rapids, Itasea County, Minn., and that the said 26th day of August, 1908, at 10 o'clock A. M. of said day at said office of said County Auditor in said Village of Grand Rapids, Itasca County, Minn., be and they are hereby fixed as the time and place for the hearing and considering of the said proposition hereinbefore set forth, and such other proposition or propositions affecting the same said property, as may be then have been submitted. For all necessary purposes, the pro- position submitted to said Board for said option for mining lease and the resolution adopted by said Board there- on for a hearing thereon, on August 29, 1907, and the resolution and orders of said Board relative thereto on said August 29, 1907, and the said option contract so entered into on said date, and all of the terms and conditions thereof, and of each of them, and all other acts and proceedings of said Beard of County Commissioners and the record thereof, are hereby made a part of this resolution, it being dis- tinctly understood that any extension of the said option contract shall in- clude all of the terms, provisions and conditions thereof.
