Pursuant to law,-the Board of Coun- ty Commissioners of Itasca County, Minnesota, met at the court house in the Village of Grand Rapids, this 13th day of July, 1908. All members of the Board present. A petition was presented for the es- tablishment of a highway described as follows: Beginning at the NE% of the SW% of SW% and running thence norta on sixteenth line of Township 53, Range 24, to the Town line between Townships 53 and 54; thence east to the quarter post; thence north three- quarters of a mile; thence one-quarter of a mile; thence’ north one mile; thence west three-quarters and to be connected with the Romans Road in Township 54, Range 25. Commissioner King moved that a hearing be had upon said petition at tne courthouse, Grand Rapids on Wed- nesday, the 26th day of August, 1908, at 10 olclock a. m., that C. M. King, M. O’Brien and Neil Mullins, members of this board be a committee to examine the route of said proposed road; that said committee meet at the beginning of said route on Friday, the 14th day of August, 1908, at 11 o’clock a. m., for the purpose of examining the route of said proposed road, and that said com- mittee make report to this board at the time set for hearing upon said petition. The motion was seconded by Commissioner Passard and carried by unanimous vote. On motion of Commissioner King, seconded by Commissioner O’Brien, the committee appointed to examine the bridges in tne Town of Popple, was also instructed to examine the road running from Northome south to Round Lake. A petition was presented for the es- tablishment of a highway, beginning at the northwest corner of Section 21, Township 148, Range 27, and running thence east On section line to the shore of Sand Lake; thence beginning again at the northeast corner of Section 21, Township 148, Range 27, and running north on section line one and one-half miles; thence beginning again at said northeast corner of said section 21, and running south on section line one mile, Commissioner King moved that a hearing be had upon said petition at the courthouse in Grand Rapids on Wednesday, the 26th day of August, 1908, at 10 o’clock a. m. That M. O’Brien, Neil Mullins and C. M, King, members of this board be a commit- tee to examine the route of said pro- posed road; that said committee meet at the point of beginning of said route on Saturday, the 15th day of August, 1908, at 11 o’clock a. m., for the pur- pose of examining the route of said proposed road, and that said commit- tee make report to this board at tae time set for hearing upon said peti- tion. The motion was seconded by Commissioner’ O’Brien and carried by unanimous vote. Upon motion of Commissioner King, seconded by Commissioner O’Brien, the County Superintendent of Highways was instructed to make a preliminary survey for a highway running south from Blackberry in Township 54, Range 24. William Furlong came before the Board and offered to deed to the county a strip of land for a road along the east side of Lots 5 and 6, section 26, and Lot 2, Section 35, Township 655, Range 26, upon the condition that the Board vacate the old road which runs on an irregular course througn said lands. Upon motion made, and carried, the Board agreed to accept the propo- sition. It being the time set for hearing upon the petition for forming a new ‘Town from the territory now embraced in the organized Town of Nashwauk, the same was then taken under con- sideration. There being no objections filed or offered against the granting of said petition, Commissioner Passard offered the following resolution and moved its adoption: Whereas, on the 23rd day of May, 1908, there was duly filed with the Board of County Commissioners of said County, and witha the County Aud- itor of said County, a petition signed by twenty and more, to-wit, 87 legal residing within the organized ynship of Nashwauk, same being Congressional Township No. 56 N., R. 22 W., 56 N., R. 23 W., 57 N., R. 22. W., and 57 N., R. 23 W., in Itasea County, Minnesota, praying that said Board of County Commissioners proceed ac- cording to law to detach from the said organized township of Nashwauk, Con- gressional township No. 56 N., R. 22 W., and 56 N., R. 23 W., and form said territory so detached from said town- ship of Nashwauk, into a new town, and Whereas, said petition appeared to said board to in all respects comply with the law and to be sufficient under and pursuant to law for the objects and purposes of the same, and for the form- ing of a new town from the said ter- ritory of and included in sald organ- ized township of Nashwauk, and to be signed by the required number of legal voters residing within the territory to be affected, more than 20 of said legal voters so signing said petition actually residing within. said territory so prayed to be detached and formed into a new town, and sf Whereas, thereafter and on the 25th day of May, 1908, at a regular and legal meeting of said Board of County Commissioners, a resolution was duly adopted and order duly made and en- tered, that said petition be heard and considered at the regular meeting of said Board of County Commissioners on the 13th day of July, 1908, at 10 o'clock in the forenoon of said day, to be held in the Court House in the Vil- lage of Grand Rapids in said County, at said time and place, and that the time of hearing of said petition and the hearing thereon and all matters included therein, be said 13th day of July, 1908, at 10 o’clock in the fore- noon of said day at said regular meet- ing of said Board, at the court house in the Village of Grand Rapids in said county, and that said Board of County Commissioners and the County Auditor of said county proceed to give 30 days’ posted notice of the time of hearing the said petition, said notice to be posted according to law within the boundaries of the territory proposed to be formed into said new town and within the territory affected by said petition, and that said notice be served upon the clerk of said township of Nashwauk, all according to law, and Whereas, due proof was filed with this Board of County Commissioners and with the County Auditor of said County, on the first day of June, 1908, of the posting of said notice according to law, said proofs of posting of said notice being now on file witha this Board and with the said County Aud- itor, and Whereas, it appears by said proofs that due and legal notice of said hear- ing was duly posted and given accord- ing to law within the territory to be affected by said petition, and the ac- tion of said Board upon the same, said proofs showing that said notice was duly served upon the town clerk of said township of Nashwauk and duly posted in each of the said congresston- al townships, and Whereas, the said petition came on for ‘nearing at the time and place fixed by said notice to-wit, before this July, 1908, ‘held at the se in the Village of Grand Rapi said County and was duly heard and con- sidered at said time and place’ resi- dents of the territories to be aff to-wit, said township of Nashwauk, appearing in support of said petition, and no person appearing in opposition thereto and there being no objections filed with said Board or offered in opposition to the said penn end Whereas, it is established by proof offered in support of said petition that the said new town so to be formed from the territory of said townsuip of Nashwauk will not have less than 36 square miles but will in fact have 72 square miles and that the boundar- ies of the organized township of Nash- wauk will not be so changed as to re- duce its territory below 36 square miles, put that there will in fact be left with- in said organized town, 72 square miles, and that there will be left in said or- ganized town of Nashwauk 26 and more qualified voters actually resid- ing therein, and that there will be within said new town so to be formed from the territory of said organized township of Nashwauk, 25 and more qualified voters actually residing: therein, and that the real estate with- in each of said towns after the said division according to the last preceding assessment will be $30,000 and more to-wit, the real estate in said organ- ized town ‘of Nashwauk remaining therein will be $5,808,625.00 and that the value of the real estate in said new town to be so formed as shown by the last preceding assessment, will be_$2,624,438.00, and Whereas, it appears to this Board that all of the facts set forth in said petition are true, and that it is to the best interest of all the people residing within said township of Nashwauk and in each of the several congressional townships embraced ‘therein, and es- necially the said townships No, 56 N., R. 22 W., and 56 N., R. 23 W., that the said territory to be detached from the organized township of Nashwauk, and be formed into a new town under and pursuant to the Laws of the State of Minnesota, having, possessing and en- joying all of the powers and privileges of organized towns within the State of Minnesota, under and pursuant to the laws thereof. The motion Was seconded and carried. Commissioner King moved that the sum of $200.00 be appropriated from the County Road and Bridge Fund, to be expended under the direction of Commissioner Mullins in the construc- tion of a portion of the Range Line Road, beginning at the southeast cor- ner of Section 13, Township 65, Range 25. and running north on Range line. The motion was seconded by Commis- sioner Passard and carried by unani- mius vote. 4 Commissioner King moved that the sum of $300.00 be appropriated from the County road and bridge fund to be expended under the direction of Commissioney Sundloff in the construc- tion of a portion of the Popple road north of Cut-Foot-Sioux. The motion Was seconded by Commissioner Pas- sard and carried by unanimous vote. It being the time set for hearing upon the petition for a highway in Townships 57 of Ranges 26 and 27, known as the Moose Lake road, the committee filed the following report: To the Board of County Commissioners of the County of Itasca, Minnesota: The undersigned committee appoint- ed by you to examine the proposed route of a highway, as stated in the petition referred to in your order of appointment made on the 25th day ot May, 1908, would respectfully report that we met at the time and place designated in your said order, and pro- ceeded to examine the highway pro- posed to be established. _Beginning at the center of Section 25, T. 57, R. 27, and running thence east on said 4 line to the shore of Moose Lake thence following lake shore in a southeasterly direction to about the west % line of Section 30; thence following the north shore of Deer Lake to section line between Sec- tions 30 and 31; thence east on section line to shore of Moose Lake; thence around shore of lake to section line between Sections 29 and 32; thence east on Section line to 4% corner be- tween Sections 29 and 32, T. 57, R. 26; thence in a northeasterly direction and connecting with old Grand Rapids road. The courses and distances of said road peing more particularly de- scribed’ in the report of the survey of said road by the County Superin- tendent of Highways, which report is on file in the office of the County Auditor, And do hereby by the opinion of a majority of said committee recom- mend that the prayer of said peti- tioners be granted.
