The contest case of Wesley Me- Mullen against the homestead entry of Joseph A. Brown, for the ef of the ne} of Section 10, and the s} of the nw} of Section 11-51-29 which was heard at the Daluth land oflice last week was decided in favor of McMullen. ‘Tbe claim is a very valuable one, being heav:ly timbered with pine, Acvording to the testi- mony Brown had first settled on the land in 1892 and then absented him- self for fifteen months. Tis reason for so doing was that he feared he nated. He claimed that he waa driven by a force from his claim and and t ke had been prevented from returning from fear harm. brown testified that in 1895 Jamea L. Clara Brown gave teseimony to the effect that a number of men had come to the house one day and giv- en Mrs. Brown notice to leave with- in ten days. Brown himself had not endeavored to ascertnin. what was the grievance harbored against him by hls neighbors nor did he complain to the authorities, The reason for tk Brown explained was that he was afraid that some one hiding behind a tree would shoot him dow The land o ls, however, took but little stock in the story and gave a decission of above. ©. ©. Me- Carthy of this village was the attor- ney for Mr. McMullen. Holtman on Western Mesaba. W. B. Holman, the former owner of the fee to the Holman forty mine near Grand Rapids, is at the Mc- Kay this morning, accompanied by Mrs. Holman,” says the Duluth Hlerald. ‘He says he understands that Morton Miller has practically sold the mine to the Donora Mining company for $300,000. The ex- plorers of the property paid Mr- Holman $30,990 for it. They sold a half interest in the fee subsequent- ly to Mr. Miller for $30,000 and then it is understood, sold the other half to him for $150,000. Within a year, according to this, a total of $300,000 has been made by three sets of parties out of what for a long time was considered only an average homestead. «<Jron has been found within two and a half miles of Grand Ra- pids,’ smd Mr. Holman. ‘i don’t know of the exact description but the property lies between Grand Rapids and Prairie river, and :t is said is being explored by Corrigan- McKinney or George W. Wallace. AND PRAIRIE FIRES. The following are liable to a penalty not exceeding $500 or imprisonment in the state prison not over ten years or abth: Any person who maliciously sets or causes to be set on fire any woods. prairie or other combustible material whereby the property of another is destroyed and life is sacrificed, The following are liable to a penalty not ex- ceeding $100 or imprisonment not exceed- ing three months: Any person refusing,without cause, to assist fire wardens in extinguishing forest or prairie fires. Any fire warden who neglects to perform his duties, Any person who wilfully, negligenUy or carelessly sets fire, or causes to be set on fire any woods, prairie or other combustible ma- terial thereby causing injury to another, Any person who shall kindle: a fire on or dangerously near to forest or prairie land and leave it unquenched, or who may be a party thereto. : ‘Any person who shall use other than incom- bustible fire wads for firearms or curry a na- ked torch, firebrand or other exposed light in or dangerously near to forest. Anyiperson who shall wilfully or heedlessly deface, destroy or remove this or any other warning placard posted under the require- ments of the above mentioned Act. Any railroad company wilfully neglecting to provide efficient spark arresters on its en- gines; or to keep its right of way to the width of 100 feet cleared of combustible material; or which shail fail to comply with other pro- visions of Section 12 of the above mentioned Act. The following are liable to a penalty of not less than $5. nor more than $50: Any railroad employe who, wilfully violates the provisions of Section 12 of the above men- tioned Act Any owner of threshing or other portable steam gengine who neglects to have efficient spark arresters, or who shall deposit live coals or hot ashes without extinguishing the same.
