Solomon Williams an old resident of this county and now residing in the vicinity of Vermillion brook in Cass county who was indicted by the grand jury of that county upon the charge of murder in the first degree 1s again a free man and has returned to his farm on Vermillion. The crime for which Williams was indicted was committed on the 24th day of May last when itis alleged that the de- fendant without any provocation took the life of one James H. Morris while he was residing upon his, Wil- liams’, farm. The facts will no doubt be fresh in the memory of most’ of our readers and they were shortly these, that on the morning of the 24 of May last some trouble had taken place between the wife of Morris and Williams which acculminated in a fight between Morris and the defen- dant, shortly afterwards according to the prosecution Williams who had got the worst of it in the affray returned to the house and after washing and cleaning his clothes left the house taking with him his rifle 38-55 calibre and proceeded towards the boat land- ing upon Vermillion brook and whea a short distance away from the house he called Morris down to him and without provocation shot tim, Wil- liams on the other hand claims he was followed by Morris towards the boat landing and was assaulted by Morris with two deer feet held in one hand and a heavy clubin the other and after directing two blows upon Williams he was knocked to the ground and while upsn the ground he tired the shots at the deceased four inall, Williams immediately after the shooting took his boat and came to Grand Rapids and surrendered to Js and a few days later was transferred to Walker where he has veen confined awaiting the acting of the grand jury who indicted him for the crime as above mentioned. ‘Lhe’ case commenced on Monday last at Walker and the state was represent ed by County Attorney B. F, Hart- shorn of Walker and E, M. Stanton of Cass Lake Minn. while the defen- se was conducted by Attorney Frank F. Price of Duluth and Grand Rapids Minn. The task of securing the jury to try Uhe defendant was completed about 8330 p. m. on Tuesday and the state atonce proceeded to introduce its testimony. Among the witnesses called by the state were Mrs. Morris the widow of the deceased and her daughter Nancy Morrsis both of whom claim to be eye witnesses to the homicide and there testimony was to the effect that Morris stood outside the kitchen dvor of the house in the yard while Williams stood ata distance about 160 feet away and nearer the brook aud Williams upon seeing Morris come out of the house called to him saying ‘“O Jimmie I want to see you before I go to town” Morris im- mediately started down towards Wil- liams and when he got within 28 feet from where Williams stood he was commanded by Williams to stop and he immediately commenced to empty the contents of his rifle into the body of Morris firing as the state claimed no less than six shots at him three-of which took eflect in the body and be- ing traced by the attending physician Dr. Thomas Russ2ll of this town. The other witneses called by the state were George McGuire, David Michaud Ed Bergen, and Owen Skelly. The defense claimed by Williams was that he acted in self defense and that he fired the shots four in number at Morris belieying at the time that he fired the same that he was in danger of losing his life as he claimed the deceased had made threats against his life to several parties. William went upon the witness stand in his own behalf and toid his story ina plain quiet way and his manner upon the stand seem tocarry weight and conviction to the minds of the jury. A large number of witnesses from this town testified to the previous FIRST-CLASS IN EVERY RESPECT. Sample Room and Livery in Connection. ITO OT TOOT NZ A good character of the defendant asa aquiet peaceful law abiding citizen, and also to the bad character of Mor- risas to his turbulent and violent nature and also as tu the reputation of Mrs. Morris for truth veracity. Amongst the wit nesses examined for the defense from here were Deputy Sheriff Kearney, Justice H. Marshal Frank McCormick, Holman, Mrs. Gillineau, and John Howard from Deer River, George Mc- Guire, David Mishaud Vermillion, Owen Skelly Cohbassett, and John P. Humphrey of Minneapolis. The tes- timony was closed late on Friday t evening last and the Counsel com- menced their arguments to the jury first thing on Saturday morning, the same occupying the time of the court until the noon recess. Immediately upon the reconvening of court Judge McClenan commenced his charge to the jury and the same was a clear concise and logical statement of the law in the case and was a lucid Statement of what the state must prove before the defendant could be found guilty. Everyone who heard the charge of the court delivered, claim that it was one of the brightest and clearest charges ever delivered top jury ina murder trial and is one which counsel on both sides claim was eminently fair and impartial. The jury retired in charge of an offic- er and after being ,out only thirty minutes the court was summoned to hear the verdict of not guilty pro- nounced which set the defendant free. Morris and. his wife have been known here for some vears and have borne anything but a savory reput- ation while in this town the deceased having been several times convicted in justice ‘court. for threatening to take the life of his wife and family while Mrs. Morris has on one occasion figured in Police court to do grevious bodily harm to one of her neighbors Morris was a Kentuckian by birth and was claimen to be an expert shot with a rifle he having made a bvast inhis life time that in his native state more than one life had been sacrifided thruugh the free use by him of his gun. ‘The Minneapolis and Duluth papers speak in high praise of the skilful handeling of the case fur the defense by Attoruey Price and in view of the facts that a very streng case was Made out by the state against the defendant it must have required considerable hard study to securea verdict of “uot guilty” tn 30 minutes. No man ever rode a bicycle who bad owuved a horse; ov man would own an automovile who ap- preciated the beauties of the horse.” Gov, Yates cade the visitors to the show and to the convention of the International Live Stock association welceme to the state. The governor was followed by R. W. Hall. The exhibit of the Minnesota university experiment station was verv much in evidence in the prize winnings. Fifteen prizes on cattle, including ffve firsts, aud sixteen prizes on hogs, eight first and eight second, ‘all in open classes, were awarded the North Star stave ex- hibit. The winnings aggregate.$718. Le Grande Powers of Minnesota, chief statistican of the division of agriculture, census bureau, is on his way to the citv to attend the show. He will address the convention on the results of the live stock inquiry made by the present house.—St. Paul Pioheer Press. Came Near Dying.
