The contention that labor unions are not subject to the anti-trust laws “unless they become part of a ccmbination of employers which commits acts in violation of the law” was set up by Lee Pressman, counsel for the C. I. O., in connec- tion with a brief on file today in the Supreme Court in the Apex Hosiery case. In this case, due shortly for argu- ment, a C. I. O. union of hosiery D. C., WEDNESDAY, workers in Philadelphia was as- sessed $711,000 damages under the Sherman Anti-Trust Act as the re- sult of a strike at the Apex plant. The Third Circuit Court of Appeals reversed this judgment and the company took the litigation to the Supreme Court. Mr. Pressman filed a statement in this case shortly after Justice Peyton Gordon, in District Court, had held that the Teamsters’ Union here and five officers were subject to prosecution under the anti-trust laws for allegedly restraining build- ing operations in a dispute with an associate union, the Operating En- gineers. 3 MARCH 27, 1940.
