VOID U. S. District Court Jurist Was Hearing Test of Guffey Act. By the Associated Press. BIRMINGHAM, Ala., October 28.— Judge Willlam I. Grubb, who pre- sided over the Northern Alabama United States District Court for more than 25 years, died at his home here yesterday from a heart attack. Judge Grubb, who was in his 74th year, had attracted national atten- tion the past year in two decisions that held adversely in two cases in- volving the “New Deal.” He was the first Federal judge to hold the N. R. A. unconstitutional, so ruling in a consent case in sustain- ing demurrers in the Belcher Lumber Co. case. Early this year, after an extended hearing, he held the electrification | program of the Tennessee Valley Au- | thority unconstitutional in a suit brought by a group of preferred share- holders of the Alabama Power Co. to prevent the utility from selling cer- | tain of its properties to T. V. A. Was Hearing Guffey Case. Although he had not been in good | | health for many months, Judge Grubb | remained active on the bench, and | only Saturday had presided in a case | involving the Guffey act, creating a little “N. R. A.” for the coal industry. He apparently was in good spirits and improved health as he left for | his home. When stricken, Judge | Grubb was about to accompany Mrs. | | Grubb to church, He died within a | | few minutes. Judge Grubb was appointed to Qhe( | Federal bench by the late President | | Willlam Howard Taft on May 18, | 1909. On the occasion of his twenty- | fifth anniversary on the bench, when | | | the Alabama bar honored the occasion \uh appropriate ceremonies, Judge Grubb said he had no intention of retiring, expressing the wish “to die | on the bench,” and remain active to the end. Received Many Hnnors. His judicial temperament and in- terpretation of the law brought him distinction, and he frequently was elected to serve on the United States Circuit Court of Appeals. The De- partment of Justice had conferred other marked distinctions upon him. Judge Grubb was born in Cincinnati, Ohio, on March 8. 1862. He was grad- uated tfrom the academic department of Yale University with high honors, and then studied law at Cincinnati University. He came to Birmingham in 1888 and began the practice of law, continuing | until he was appointed to the Federal bench. On June 18, 1906, he married Alice | C. Vigo of Tuscaloosa, Ala, who with three children. Mrs. Edgar Idol of | Washington, D. C.; Archie Grubb, | and W. I. Grubb, jr, of Birmingham, | survive. He was a Democrat and a Presby- terian. After a week'’s illness of pneumonia, | contracted while returning to Wash- ington on a train from California, John J. Marquette, 56, a member of the United States Board of Tax Ap- peals, died Saturday in Sibley Hos- pital. Considered one of the most capable members of the board, Mr. Marquette had gone to Calffornia to hear a case involving evaluation of the estate of the late Henry Huntington, railroad magnate. The Huntington estate in- | cluded approximately 4,000 pieces of eal estate besides other property. Educated in West. Born in Utica, N. Y., Mr. Marquette moved West as a youth and studled at North Dakota Universily, where he was graduated with a law degree. He began his law career at Missoula, Mont., and practiced there for several years. At the outbreak of the Spanish- American War Mr. Marquette en- listed in the Army and served two years in the Philippines. He served in the Army again during the World War, this time as a captain in the Air Corps. After flying at Kelly Field, | in Texas, he was stationed at Bolling Field here. He was injured crack-up in 1919. which confined him | to the Walter Reed Hospital for & year and left him lame. Was Legal Adviser. After leaving the military service in 1920, Mr. Marquette entered the office of the solicitor in the Internal Revenue Bureau. He served as a legal adviser until his appointment to the Tax Appeal Board in 1924. In the latter position he figured in | several of the Government's largest including the Couzens case, in which the evaluation of the Ford es- tate was involved. His only survivor is his widow, Mrs, J. P. Marquette of Washinzton. CHARITY LEADER’S FUNERAL TOMORROW | Mrs. Martha Wells Adams Dies After Short Ill- ness. Mrs. Martha Wells Adams, a leader | in religious and charitable work in | the District, died yesterday at her | | home in the Woodley Park Towers, | 2737 Devonshire place, after a brief | | illness. She was the widow of Robert Adams and the daughter of Gen. John H. Burial will be in Arlington National Cemetery. Mrs. Adams was born in Waynes- burg, Pa, but had lived in Washing- ton most of her life. She was actively associated with the Sibley Hospital Guild, the Swartzel Home for Chil- dren, the Methodist Home, the Wom- an’s Christian Temperance Union and various missionary societies.
