- TVATOSTESS DEFNSE NEEDS Authority Will Cite War Re- quirements to Sustain Point in Court. _— By the Associated Press. BIRMINGHAM, Ala, February 18 —Whipping together a picture of the Government's war-time projects at Muscle Shoals as still forming a keystone in national defense, attor- neys for the Tennessee Valley Au- thority indicated tonight that Mon- day the highly controverted power program would be presented in United States District Court here. The power program, on which the whole case is based, has not figured thus far in T. V. A's presentation | of its defense, except as it related to other aims. Three Objectives Cited. In nearly six days of testimony, eounsel for T. V. A. has sought to show that the authority's program is aimed at three major objectives, navigation, flood control and national | defense, with production of fertilizer and experiment and electricity only incidental to the general scheme. Dr. Harry A. Curtis, chief chemical engineer of the T. V. A, today de- clared the Shoals plants were not ob- solete, and in time of war could quickly be converted to production of nitrogen for ammunition and phos- phorus for chemical warfare. A fleld botanist formerly attached fo the National Park Service, Mrs. Baggley has completed a new manual of Yellowstone plants. She was the only woman in the Park Service, until her resignation last year, with the rank of junior park naturalist. Fatally Shot at Dance. CARTHAGE, Mo., February 16 (#). —Oris Massey, 33, deputy collector of internal revenue with headquarters at Joplin, Mo., died yesterday of a bullet wound received in a fight with Warren Swank, Golden City night- watchman, at a dance hall. Swank said Massey was drunk and attacked him when asked: “Brother, where are you from?" 3 No charges have been filed.
