By the Associated Press. - Federal Judge Harold Louderback is {ree to take again the bench in Cali- fornia, acquitted by the Senate on the five impeachment counts brought against him. He said to resign now would be “lflz’ and like playing into his enemies’ hands, even though a majority of the Senate registered disapproval of his conduct in receivership cases by voting against him on the final general charge of conduct “prejudicial to the dignity of the judiciary.” “I feel that it is a vindication,” he smilingly told those Senators who crossed the chamber to congratulate him when the verdict had been ren- dered late yesterday after nine days of trial. On that last charge, summarizing the four others, the majority that voted “guilty” fell far short of the two- thirds needed to convict. The Sena- tors had debated his case in executive sesslon for two hours before readmit- ting the public: to the balloting. Con- viction on a single count would have removed him {rom office. Based on Appointment. Louderback 'was accused of “tyranny,” “favoritism,” “unlawful conduct as & judge,” “misbehavior in office” and with being a “hindrance to litigants” in the varfous charges. The prosecution was based on his appointment of H. B. Hunter for the Russell-Colvin Brokerage Co. of San Francisco and J. D. Short as his at- torney; sappointment and alleged grant- ing of fees to Marshall Woodworth as attorney and Samuel Shortridge, jr., as receiver for the Lumberman’s Re- ciprocal Association; appointment of G. H. Gilbert as receiver for the Fageol Motor ‘Co., and upon his grant of re- celvership papers for the Prudential 2 | Holding Co. The verdicts varied from 63 not guilty and 11 guilty in the Gilbert count to 45 guilty and 34 not guilty on the final, all-inclusive charge.
