The ls were tentatively set for April 7. The disorders started when the depu- ties attempted to serve attachment papers on the live stock of Cliff Jeans, Negro tenant farmer. Jeans refused to surrender the live stock and the officers went to Talla- hassee, 8 miles away, for assistance. ‘When they returned to the Jeans home more than 75 Negroes had assembled and a gun battle followed. One Negro was killed at the home and two later died of their wounds in jail at Montgomery, where they had been carried for safe keeping. Mrs. Perdue was called by defens: counsel in an effort to show animosity & toward Mr. Conway had existed prior to | the alleged attempt to attack the Huff- | man girl. She quoted Mrs. Huffman as | saying, “that Conway family is too | brilliant. They'll do all the singing in | the church and the others won't get a chance to sing.” ‘This statement provoked a remark by Deputy Prosecutor O. M. Rearick | that “Conway Cunched Willard Aurand over the church chancel rail, didn't! he?” The gninister also is under in- | dictment for assault and battery on Aurand, choir leader at his church. Counsel for Mr. Conway moved for dismissal of the present case on the contention that Rearick’s reference to the Aurand incident was out of order. Judge L. A. Guthrie denied the motion, but cautioned the attorneys to confine their remarks to the case now on trial.
