APPEALS COURT RULE ON LOAN SHARK LAW Real Estate Transactions Are Held Not Within Scope in Zirkle Case, The District Court of Appeals yester- day held that the loan shark law has no applicability to loans on real estate and is confined to loans not exceeding $200 on the security of personal property N | made by a person engaged in the busi- | ness of loaning money. The opinion, handed down by Justice Charles H. Robb, reversed a judgment of the Dis- trict Supreme Court awarded to Wil- mer D, Zirkle against Adelaide H. Daly. Zirkle had purchased a second deed of trust note secured on real estate and after foreclosure had sued for a' deflcit remaining after the proceeds of | sale had been credited. The defendant | charged Zirkle had lent the money and | had charged usurious interest for its | use The lower court instructed the | jury that 1if it found the contention of the defendant to be right it should deduct not only all interest payments from the face of the note, but also one-fourth of the principal as provided in the loan shark law.
