C., FRIDAY, IN CANNON PROBE Bishop’s Supporters Say Re- ligious and Political Enemies Seek Inquiry. Supporters of Bishop James Cannon, Jr., belleve the effort of the Senate to investigate his anti-Smith activities in 1928 is prompted by religlous and politi- cal prejudice, the churchman yester- day wrote Chairman Nye of the Senate Campaign Investigating Committee. Bishop Cannon’s letter followed the recent refusal of Nye to postpone hear- ings until September 20, the chairman holding that the statute of lmitations would be applicable in the case Septem- ber 1. Bishop Cannon, denying the statute of limitations could apply, said that even if it could be invoked contributions made later would “give ample margin for hearings begun on September 20. Prejudice Is Charged. ‘The bishop then said his correspond- ence indicated ghnlm p‘sre'::‘:e think the purpose underlying e Teso- lution directing the investigation “is an effort to use your committee as an in- strument to please Congressman Tink- ham’'s (Representative Tinkham, Re- publican, Massachusetts) wet, Roman Catholic, Boston constituency, to gratify the anger and wounded vanity of cer- tain Virginia Democrats and to secure, if possible, the list of names of those who worked in Virginia cities, districts and precincts to defeat Alfred E. Smith, in order that, if possible, they may be so intimidated and hsr;ssed that they will fear to do such work again.” e“Thnt list,” he continued, “will cer- tainly not be furnished by me.” The committee is investigating & com- plaint by Representative Tinkham that the bishop failed to account for a major portion of the $65,300 given him by E. C. Jameson, New York financier, for use against the presidential candidacy of former Gov. gmlt.h in Virginia. Bishop Called on Nye. Bishop Cannon said he had called on Nye May 18 to learn the date of future hearings as he desired to be present, and that the chairman told him he did not think it probable additional hear- ings would be held until the latter part of August. “I then said,” he continued, “that! if the hearings would not be resumed until the latter part of August, I would be glad if they could be delayed until about the 20th of Eeptember, as I desired to attend important church and prohibition conferences in Europe. I gave you the dates * * * and sald that by taking a fast steamer I could get home by September 20.” Bishop Cannon sald Nye's reference to the statute “clearly” indicated “that the chairman of the committee does consider that the committee is acting in the capacity of a grand jury investi- gating a complaint that I have com- mitted a crime for which I must be indicted before the expiration of the three-year lmit.” The bishop has challenged the authority of the committee to inquire into his disposition of the funds.
