(S B-16 TAX APPEALS BOARD RULING REVERSED Los Angeles Park Company| Wins Decision on Deficiency ' Assessment for 1917. Because the United States Board of | fTax Appeals refused to permit iho| Alameda Park Co. of Los Angeles to amend its petition for remittance of a deficiency of $4,457.69 assessed on its | W yeturn for 1917, by adding a plea of the statute of limitations, the District | Court of Appeals yesterday reversed the | action of the board and directed that the amendment be permitted. The rec- ord showed that more than 5 years had elapsed before an effort was made by the Government to collect the dificiency and in an opinion by Chief Justice Martin the court points out that the | plea of the statute is not regarded wit | disfavor by the taxing statutes and | where the facts appearing in the case | disclose such a defense, although not | pleaded. a due exercise of judicial dis- | cretion requires that an amendment | should be allowed in order to make the pleadings conform with the facts. Another Decision Reversed. The board’s action was also reversed | in an opinion by Justice Charles H.| Robb on the appeal of the Davidson Grocery Co. of Boise, Idaho. The | amount involved was $6.063.03 which the company had deducted from its yeturn for the year 1920 as uncollectible to that extent after the debtors had been placed in the hands of a receiver. The Internal Revenue Bureau and the Board of Tax Appeals both held that “debts ascertained to be worthless" re- lates to debts that are wholly worthless | and that no deduction may be taken in the year when a debt is ascertained to | be partially worthless. Following a de- cision in the second circuit the’ opinion holds that there is no apparent reason either in fact or in law why a deduc- tion from gross income should not be made in the year in which such losses are fixed by the occurrence of events that prevent their collection, Affirmed in Two Cases. The Board of Tax Appeals was affirmed in two other decisions of the court in one of which it had held that Lec Rosenberg of New York was not en- titled to claim Texarkana, Tex., as his domicile, bpt must make his income re- turns from New York. In the other 4t upheld a ruling that the Henningsen Produce Co. of Nebraska was not en- titled to charge off $5,460.45 from its return for 1918 FIRE HEROES PRAISED. Chief Receives Letter From H. M. SECRETARY OF LODGE 1S ACCUSED OF THEFT Grand Jury Indicts Floyd C. Payne in Embezzlement of $2,040. An indictment charging Floyd C. Payne, colored, financial secretary of the Morning Star Lodge, No. 40, of the Improved Benevolent Protective Order of Elks of the World, with embezzling $2,040.24 of the funds of the order was returned yesterday by the District grand jury. A number of trustees of the order are named as witnesses, the discrepancy having been revealed at the annuai audit of Payne's accounts. ‘The grand jury aleo returned indict- ments against Roy an” Joseph Harris, brothers, and Walter Harris, of Central Heights, on charges of possessing copper plates and equipment for counterfeiting money. - The arrest of the three men followed investigation by Policeman S. R. McKee of the eleventh precinct into a liquor complaint against the garage which they used as a workshop. At the garage McKee found the men with green ink on their hands, he said. A search of the premises resulted in the revealing of a copper plate for a $10 bill and sev- eral crude samples. Police say that one of the alleged counterfeiters declared he had been per- fecting his art for more than a year | and that he had been twice lhl‘ough the Bureau of r:ngravxng and Printing.
