Decision Due Tomorrow. Tomorrow morning a small item of testimony will be heard and then Jus- tice Hitz will inform counsel what prayers he has granted, after which the arguments of summation will be- gin. Justice Hitz told the jurors yes- terday afternoon, as he excused them when the question of prayers was brought up, that it is “‘not impossible that we will finish this case this week." Assistant United States Attorney George D. Horning, jr., emphasized to the court that “the position of the Government is that manslaughter does not enter into the case. It is murder or nothing.” He then citéd the case as the defendants themselves view it, explaining that Proctor said he dfd not fire, in which event there is no manslaughter. Likewise manslaughter could not be applied to Moreno, who testified that he fired, but not at Po- liceman Leo W. K. Busch, and only after he had been shot by Policeman Frank L. Ach, Horning said. Eagles’ revised testimony was that he fired, but not at Busch, so there could be no manslaughter verdict for that defend- ant, the prosecutor declared. McCabe's Attorney Heard. James A. O'Shea, attorney for Mc- Cabe, said his defense was “not guilty” from beginning to end, and after emphasizing - that point, he spoke on the. possibility of man- slaughter for the other defendants. He raised the question of arrest, whether it was legal and whether a right to resist arrest existed. If the arrest was illegal and attempted in a “rough and wanton" manner, O'Shea declared, then the killing of the po- liceman would not be murder, but manslaughter. Horning replied that the four de- fendants did not resist arrest, pointing out that Ach turned his two men loose when the first ‘shot was fired and explaining that Busch never laid his hands on either of the other two il RITES FOR G. John Fleming, Rev. John Fink, Rev. Stephan McNamee, Rev. Willlam Carey and Rev. Francis X. Cavanagh, The services at the grave were con- ducted by Rev. Owen Murphy.
