Arme WISCONSIN REALTY BOARD IS UPHELD Refused Florida Company License Because Complete Financial Statement Was Refused. By the Associated Pregg, MADISON, Wis,, December 23.— Examination of the complete decision of the Wisconsin Supreme Court which on December 7 denled a real estate brokerage license to the Dur- ham Tropical Co. of St. Petersburg, Fla., showed that the finding was chiefly a justification of the State real estate board's demand for a full finan- cial statement from the company. This statement was refused by the company at the initial hearing before the baord, and the Dane County Cir- cuit Court upheld the position of the st in these notes should it become he balance of the capital require- ments will come from the marketing of 7 per cent cumulative preferred stock of the corporation and common stock of the cerporation without par ue in units of share of pre- serred and one share of common. 800,000 Shares of Common. Mr. Green’s bill will provide for is- suance of 800,000 sh s of preferred stock at a par value $100 a share of common t the outset by the Becre of the Treasury. In time they would be elected by stockholders. A limitation would be placed upon the profits of the corporation. While the Government would re- tain authority to participate in the flnancing of the corporation through direct appropriation, the Treasury view is t all of the funds necessary for operating the sys provided by the inv by the owners of the wexisting stocks of med al liquors now in bonded warehouses. The common and capi- 1al stock provided for would be ex- changed for the liquors, at a. fair market value. The corporation would set up two distilleries, one for Bourbon and one for rye whisky, within some State where local law permits, and would #ell its product only to persons legal- Ty entitled to a supply. Until a con- templated $35,000,000 issue of \gold motes is paid off the Secretary of the Yreasury would name all or a ma- jority of the corporate board of di- rectors, and the Government, even after the stockholders had, taken en- tire control of the business, would have special rights to regulate and supervise the corporation’s activities. 2 bonded warehouses Now used for whisky storage would Be kept in service, the Treasury De- partment said. New stocks of whisky for medicinal purpgse must be manufactured short- 1y, the statement added, since at least five years' aging is required. LUTHERANS NAME ENVOY.| Dr. W. H. Greever Is Chosen to Go to Lausanne. NEW YORK, December 23 (#).— Dr. . H. Greever, editor of the American Lutheran Survey, Co- Jumbia, S. C., was elected yvesterday by the executive board of the United Lutheran Church in America as one of the delegation to the World Con- ference on ‘aith and Order at Lausanne, Switzerland, next Sum- mer. The board has reduced its repre- sentation from six to four delegates. The oth are Dr. John A. W. The board thereupon ap- pealed to the Supreme Court. In its findings the high court did not ascribe “frauds of amazing pro- portions” to this company, but men- tioned them only as having been per- petrated by others in -the past and hence as having created an atmos- phere of suspicion as to deals in lands | far distant from Wisconsin which justified the real estate board in ask- ing a full financial statement from this company. The Supreme Court reviewed testi- mony by the Wisconsin representa- tive of the company, who told the board that the land could be cleared for from $15 to $30 an acre and that they proposed to sell it for §75 an acre. He also testified that it would cost about $125 to fertilize the land, the Supreme Court said. “This statement as to fertilizer is significantly absent from the adver- tising matter submitted.” It also quoted the witness’ rejoinder: “I do not think that a man selling land in Wisconsin is expected to tell a purchaser how much fertilizer is necessary.” The high court review also brought out testimony that the company’s authorized capital was $500,000, of which $100,000 was paid in, and that it owned a tract containing 60,000 acres, which, if sold at the indicated price, would bring in $4,500,000. It was after this testimony that the board asked the full financial state- ;nni:t. and the Supreme Court decision “The refusal to comply with this request was a suspicious circumstance fully justifying the board in denying the Ticense.” DANCERS INCORPORATE.
