The District Court of Appeals yester- day held that it is a violation of law for a street car company to operate an open-platform car which does not protect the moterman from the in- clement weather. In an opinfon by Chief Justice Martin the appellate tribunal affirmed the action of Judge John P. McMahon of Police Court, THE EVENING who had convicted the Washington Railway and Electric Co. of violating the act of March 3, 1906. ‘The prohibition under the act does not apply to cars run between April 1 and November 1 of each year. ‘The company contended that the act .| had been repealsd either by the act of May 23 1908, or by the enactment of March 4, 1913, but the court finds there was no such repeal as clalmed by counsel for the company, and de- clarad the acts are not inconsistent or repugnant.
