THREATENS TO DROP KARDOS CASE TRIAL Judge Warns of Action Unless At- torneys Stop Delaying Proceedings. By the Associated Press. NEW YORK, December 13.—Warn- ing was served by Judge Charles C. Nott, who is presiding at the trial of Louis Montgomery Kardos, jr., a partner In the defunct brokerage con- cern of Kardos & Burke, charged with having felonfously _traded agalnst customers’ accoynts, that un- less the attorneys for the prosecu- tion and the defense ceased to quibble among themselves and immedlately proceed with the examination of wit- nesses, he would declare a mistrial, increase the bail of the defendant or commit him to jail pending a retrial. The judicial warning was issued during the cross-examination of Mrs. Florence Noble, Brooklyn, against whose account Kardos is specifically charged with having traded on “house accounts.” The trial up to that point had been marked by fre- quent objections and a running fire of cross-comments eounsel. . Mrs. Noble testified that on Janu- ary 20, 1922, she had given an order, through a Brooklyn branch of thé ‘firm, for the purchase of 50 shares of Chandler Motor stock. She never received the stock, she said, but later had been informed that the stock had been sold, and received a “confirma- tion of sale”” She had never given an order for the sale of the stock, shé said. Other witnesses testified as to deal- ings with the defunct brokerage firm. Miss Harriet Kaplan, head book- keeper for the firm, gave an account on the witness stand of the manner in ‘which the okerage firm dealt in “‘cross-orde: which had the effect of nullifying customers’ orders, and ‘relieved the house of actually carry- m; the stock which customers had between opposing rchased.
