Himes of Ohio instituted suit today in the Di: l trict Supreme Court for injunction and Teceiver against the Lincoln Hotel Corporation, J. C. Myers, A. Robert Elmore, Thomas P. Bones and James D. Hobbs. Mr. Himes, through Attorneys Wilton J. Lambert and R. H. Yeatman, says in his bill that in January he contributed $50,000 to the defendant company to enable it to purchase the property at 12th and H streets northwest. for the erection of a proposed Lincoin Hotel. and that an agreement was executed by the company whereby certain pre- | ferred stock was delivered to him and a majority of the common stock was placed in a voting trust. Mr. Himes further says that it has just come to his notice that on Satur- day a deed of all the prope was recorded to the defendants. Bones and Hobbs.
